complaint seems to relate to complaints he has against one of our clients
Mr*** advises that he has been contacted by a company, Ppin Holdings LLC (PPHLLC), in regards to collections for a commercial personal Guaranty that Mr*** executed relating to a finance lease for commercial credit card Processing equiptment between CLD Towing and CIT Financial USA (CIT)Per prior notices to Mr***, and as was outlined in my letter to Mr***, PPHLLC has acquired by assignment the rights to the Agreement and Guaranty between Mr*** and CIT
A copy of the subject Lease and Guaranty containing Mr***'s signature was included with my initial correspondence letterI have advised my client to forward to Mr*** an additional copy of the subject contract to try to once again help familiarize himself with the subject of the dispute
Per my client's files and records, the subject contract went into default when the Lessee (CLD Towing) failed to make its payments under the LeasePer the terms of the Lease, CLD promised unconditionally to make all Lease payments (per month) when due for a period of monthsPer the terms of the Personal Guaranty, as Guarantor, Mr*** promised to be personally liable for payments of CLDAs CLD defaulted under the Lease, PPHLLC is now seeking remuneration from Mr*** pursuant to the personal Guaranty
At this juncture, my client is amenable to working out a resolution by which Mr*** can satisfy his obligations under the subject GuarantyMr*** is authorized to contact my client's legal collections department directly 1-800-683-(If he calls, he should refer to my client's file number XXXXXXX)Furthermore, I have advised my client to reach out to Mr*** to determine if they can resolve the matter
