Last August I began the process of bidding on a HUD owned home. During this process I was told by HUD I had to use a HUD approved lawyer and they connected me with Attorney Vitally Y at the Law Offices Of Brian S. With any home I had to submit a deposit when the offer was accepted, except it was two deposits one for $1,000 with a proof of funds, and one for $150 to grant access to turn utilities on for inspection purposes. Both of those deposits were to be returned to me if the closing it not go through. Fast forward to maybe 3 months later. I needed the attorney to help solve an issue during the closing of which the bank and HUD could not agree on. After asking the attorney to defend my behalf -considering I was paying him at the time of closing, he did not defend or say a word to any of the parties involved. I received an email saying his work was completed. After not receiving a Clear to Close letter from the Financial institution used the work of his end was done prematurely. I never got to close on this home because the bank and HUD could not make an agreement based on the work that needed to be done to the home. I contacted HUD with the piper documents needed to cancel the agreements and get my deposits returned. They advised me that they sent my deposits total of $1150 to Vitally Y Mr. Y had not returned an email about my money in two months. Finally he contacted me and said ? I miss read the contract. I will need address to mail your deposit too, also I kindly request you pay me $400 for lost wages during the closing. You can be billed separately or I can deduct the funds from your deposits.? I kindly replied asking him to mail my deposits and a separate bill and provided my address. It has now been 3 months sense I have heard from attorney Y and I have not gotten my deposits back. I email him three times weekly and call daily and he had yet to respond.
Refund I would like my deposits refunded to me as they are my funds that were supposed to be protected by Attorney Y. I would also like the company to send me an extra $500 to settle the Emotional distress and this has caused me. I have now lost my future home, (on the day of closing, which I took off of work -lost wages, and packed all of my belongings) and have been late on payments due to the withholding of my funds.

The requested deposit is being returned to the customer without deduction or bill for the advanced costs paid to third parties in preparation for the closing. Foregoing the billing for the advance costs is the equivalent to meeting her demand for additional compensation.
