I understand the seller's concerns however, I we do not have any responsibility regarding the payment of her propane bill I think the person she need to contact is the buyer as they are the ones who have benefited from her filling the tank All parties to the contract had many opportunities to address this issue prior to the closing All parties signed the settlement statement and there was never a mention of this payment We have no way of knowing if there anything owing unless we are told prior to closing I am sorry for your inconvenienceThank you,Dee Anna [redacted]
Land Title Guarantee Co of Summit County would like to sincerely apologize to Ms. [redacted] for any misunderstanding regarding her propane tank payment. As our normal course of business, Land Title does not address [redacted] billings unless 'specifically' requested by the seller or their... Realtor. We do not have the capacity to visit the property to determine how many gallons are remaining in the gas tank at the time of closing. We rely entirely on someone involved in the transaction to inform us what they would like added to the final settlement statement. Ms. [redacted] reviewed and signed the final settlement for closing. This situation came to our attention after the closing. We were not made aware that she had pre-paid this bill. As a good will gesture, we offered to contribute $100.00 toward Ms. [redacted] bill. I am rejecting this response for the following reasons:1) On our home sale contract, item 16.4 addresses the proration of utilities, including propane. And yet, this was not addressed with me.2) One of your representatives, Amy [redacted], even admitted that it was an oversight by all parties, including their company. Please see attached email. You are the experts in home closings and Land Title Company failed to advise me properly. 3) Also in the email that Ms. [redacted] sent to Ms. [redacted], she stated that Ms. [redacted] was contractually obligated to pay this bill. It is not my fault that she, apparently, has no moral compass. It is up to the Land Title Company to pursue any violation of contract with Ms. [redacted].3) I did NOT prepay this bill--it was sent out after closing for a fill that was done just before closing.In conclusion, I am reiterating my request that Land Title company pay $243.35, which is not even half of the amount owed.
