We hired them to seal coat our driveway and ended up with a muddy black mess for a driveway. Then, after screwing not only our driveway up they did the same thing to our neighbor. We both ended up having to sue him in civil court, where we both won our judgements but still haven't received anything. He won't pay his bills.. Go look at how many times he's been sued in a civil court...
the problem we had with mr. [redacted] first of all was due to the fact that we never had a written...
contract and we just had a verbal agreement on the project. I had a written price on a proposal of around $2000.00 dollars to pave his front of drive and a side piece next to his barn. after we got done with the asphalting of his drive and barn I walked up to him to get a check ,he then asked how much it was because he forgot how much was on the proposal because it was atleast a month that passed since I gave him the proposal. I told him it was around $2000.00 he then began to say why did I go up so much in price because he thought the price of the paving was $1200. mr. owens and myself joked around a lot and I thought he was kidding me like always but he wasn't joking. so we went back and forth verbally about the price because I didn't have the proposal with me and he couldn't find the proposal either so I told him if he could atleast give me $1400 which was the amount I had in the job with trucking cost, asphalt, and my help and diesel and gas cost. I told him that he would atleast give me that I would seal his drive for no cost to him ! we never had any written binding contract of any sort with eachother . I did at one point inspect his asphalt on oct 3 of 2013 at around 2:30 to see what the condition of the asphalt was in. most of the time you have to wait atleast a year upon laying of new asphalt to seal it due to the curing of the asphalt. upon inspecting it my judgment was that it wasn't cured enough yet to seal and by sealing it premature it would cause damage to the asphalt surface.
I will seal his drive in the spring of 2014 once weather is permitting , but we did not ever have a written contract on the project .
