I have had time to review the latest from Mr [redacted] and my opinion or position has not changedThe facts of this case are quite simple, Mr [redacted] purchased a year old boat from HJV being fully aware it was being sold as is as shown without warranty as evidenced by the three separate forms Mr [redacted] signedTo say this boat was misrepresented is insaneOur delivery process precludes this from happeningWhen a person purchases a boat from HJV, they arerequiredto go on a sea trial of the boatWe put a trained technician in the boat with them to show them how all the boat systems operate and clearly demonstrate how the boat performsThis is not a rushed process, the technician is instructed to take as much time as needed with each customer to ensure they understand the boat, they have ample time to examine any flaws that the boat may have and are satisfied with their purchase.Only after all this is completed, the customer is then taken to do the paperworkThe person is then asked if they are completely satisfied and if all of the systems on the boat were shown to themIf there are any issues or problems they are resolved prior to the customer completing the transactionIt is only after we are sure they are satisfied that they are asked to sign the final documents signifying suchMr [redacted] was taken through this entire process, and then signed three documents signifying he was 100% satisfied with the condition of the boat and its systems, that he was shown the entire boat and all systems were thoroughly explained, and that he understood the boat was being represented and sold in a as is as shown no warranty conditionI am baffled as to how this can be interpreted to mean anything elseWhen a boat is sold as is as shown there is no hiding anything, because we are not representing a single system to work on the boat.Mr [redacted] also states that HJV represented that they fill all fuel tanks as a standard practiceI have been affiliated with HJV since its inception and can tell you it is not nor has it ever been the policy of HJV to fill a fuel tank as standard practice on any of its boats.Sincerely,

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Please have them directly respond to the fact they advertised the boat to be low hours (under 300) when the hour meter did not work and in fact they had disconnected it.Also please have respond directly as to why Tom did not show me the e-mail he got from the seller disclosing other issues like the broken gas gauge he go just four days before I picked it upSee Exhibit B.Had I known before I purchased the boat all the issues I would have walked away without buying itThey knowingly hid important decision making facts from meIs that not what the Revdex.com is out there to assist with? I know this business will not compensate me for all the out of pocket costs but I am willing to settle this matter for the commission they earned selling it to meFrom my calculations that amount is $1200.00.

The facts of this case are quite simple, Mr. [redacted] purchased a 21 year old boat from HJV being fully aware it was being sold as is as shown without warranty as evidenced by the three separate forms Mr. [redacted] signed. To say this boat was misrepresented is insane. Our delivery process precludes this from happening. When a person purchases a boat from HJV, they arerequiredto go on a sea trial of the boat. We put a trained technician in the boat with them to show them how all the boat systems operate and clearly demonstrate how the boat performs. The sole purpose of his phone call to me was to dispute the fact that they did not disclose all that was wrong with the boat as requested by the co-signer. I would not have bought the boat had he been honest with me about issues with the boat. See exhibit A they promoted the boat as to having under 300 hours, the hour meter did not work and they were the ones who disconnected it. Please see exhibit B. If I had not bought the boat I would not have had the repairs. He then offered to fix the gas gauge which is not practical. I do not have the means to bring the boat over 100 miles for a $250 repair.

I recently sold Lakeside Marina two boats, thinking I was being told truthful and accurate values for my board they were purchasing. Particularly a 1999 Smokercraft 168 Promag. I was told that it's an old boat and not really worth anything so I could only expect $2000 for it and they were being generous..... Well did I get taken, they listed it on Craigslist for $6999 a couple days later toting how great the boat is. The other boat they bought from me they said had mechanical issues and the motor needed to be rebuilt so they asked for money back, which I foolishly gave them, under the circumstances I felt it was the right thing to do..... I highly doubt they did any work to the motor at all since it was also posted on Craigslist within a couple days, I'm sure a rebuild would take longer than that. Take caution with this company before selling to them.

Review: On 12/4/15 my wife and I drove to Lakeside Marine in Oshkosh, WI (about 200 miles from my home) to look at a boat we had found on Greg’s List; a 1994 G&W Invader. See Exhibit A attached. It looked very good and I made an offer of $5500.00 subject to final inspection / sea trial in the spring to be sure everything was working properly which Lake side Marina had assured did. During the negotiations the co-signing seller reduced his price to $6500.00 which was more than I was willing to spend. To make the deal Tom [redacted] told me he would reduce his commission from $1000.00 to $750.00; thus reducing my cost to $6250.00 and giving the co-signer, as he told me, his desired sell price of $5500.00. (You will see later Tom [redacted] was not truthful to me regarding his commission because in Exhibit B the co-signer had agreed to a bottom line cost of $5000.00 and any amount over that was the commission for Lakeside Marina)

On 12/19/14 I entered into a purchase agreement with Lakeside Marina to buy the boat they were selling on behalf of the third party for $6250.00. I charged 10% of that price on a credit card with the agreement the final sale was contingent on the final inspection / sea trail sometime the following April. Please note in Exhibit A the boat was advertised to have less than 300 hours on its hour meter (which is the equal to a 20 year old car with 30,000 miles). You will see in Exhibit B not only did the hour meter not work, but Lakeside Marine had been the one to disconnect it. Further it was advertised to have Battery(s) implying more than one. It had two battery trays and battery selector switch.

On Saturday 4/18/15 I drove to Lakeside Marina for the final inspection / sea trials with my step son. If acceptable I would complete the transaction and bring the boat home. The boat ran well but it had only one battery in it. The co-signing owner was out of town and when we did finally reach him he offered to bring it into the marina next week. Since I was 200 miles from home that was not practical; so I was forced to purchase a new one from Lakeside Marina at a cost to me of about $100.00. When I asked Tom [redacted] if it was customary to sell a boat with a full tank of gas he responded to me and to my step son that at Team Lakeside they go out of their way to make all customers happy and that the tank was full.

On my second time out with the boat with my wife I backed out of a slip and when I put it into drive nothing happened. I took several hours to be towed back to Webb’s Marina where I had rented a slip for the season costing me $950.00. When they finally got to inspecting the boat (marinas are very busy in the spring) they found the engine coupling had failed. This required removing the entire interior of the boat so they then could remove the engine. See Exhibits C1 and C2 for costs totaling $3639.91. This also included the cost to repair the disconnected hour meter, the failing blower fan and some ductwork which had holes in it. To be perfectly transparent on this it also included $212.93 to replace the propeller which I did not do. They also told the fuel gauge did not work and the needle was pegged on full. Since I had not owned the boat long enough to notice, I inquired what that would cost to fix. Webb’s Marina told me they were not comfortable in repairing that item because if it did not go well it would be very expense to replace the gas tank. I did not have it fixed and now must deal without knowing how much fuel is in the boat. I now must fill it up each 4 hours of running time since I did pay to have the hour meter fixed. It was five weeks from the time of failure to when I got my boat back and was able to use it again – that is 20% of the boating season in northern Illinois.

I have complained to Tom [redacted] several times while the boat was being repaired. He reminded me the boat was sold as is after the final inspection / sea trial and that failure was just back luck on my part. He told me it just happens sometimes. During that time he sent me a chain of e-mails between the co-signer Shane [redacted] and him which includes Exhibit B. On Tuesday 4/14/15 Shane had disclosed several issues with the boat which Tom [redacted] acknowledged the following day. That just 4 days before I arrived for the final inspection / sea trial. The issues included in that list were that the depth sounder does not always work, the fuel gauge is sticky, “the hour meter is still disconnected since you guys disconnected it last summer”, the hydraulic trim pump trips the reset button from time to time and the oil had not been changed last fall (which is when that is normally done).

When I asked Tom [redacted] why he had not disclosed these issues as Shane had requested, he told me he had forgotten about the e-mail. It was just 4 days before I came for the final inspection / sea trial! I know they defend themselves by saying I inspected the boat, took it for the sea trail and there was no way to know the engine coupling was about to fail. However had Tom [redacted] disclosed all the issues about this boat I would have never purchased it. He knew I was looking at three other boats in the same price range but this one looked to be the best deal. He was afraid he would lose the sale.

Lakeside Marina sells dozens of boats every year and they were untruthful to me on several accounts for their company commission of just over $1000.00. I am personally out about $3400.00 and 1/5 of the 2015 boating season. I feel they owe me compensation beyond the $200.00 Tom [redacted] sent me to repair the fuel gauge (that was his estimate). I feel they should cover the full cost of the repairs $3426.98. I will live with the non-functional fuel gauge.

I have addition documentation I am unable to attach - The original advertisement, E-mails that support my claims of untruthfulness and repair bills.Desired Settlement: I feel they should cover the full cost of the repairs $3426.98.
