I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear belowDue to the length of time it took to initially stop the damage from occurring (Contractors witnessed water entering our living room and left without attempting to prevent further damage), and to complete repairs; calling this an inconvenience is a gross understatement, therefore, the $concession is insufficient

May 20,I met with the residents of *** LaFontenay Drregarding their roof leak and tobacco residue in the master bathroomI explained to the residents the roof leak process and what a repair requires(Diagnosing the leak, making a exterior repair, waiting to confirmed there is no more
leaking, once confirmed, interior repair is made)I have a roof contractor who will address the rook leak Saturday May 21, weather permitting, starting the repair processThe resident is to expect a call form me directly to inform them what is done SaturdayDuring our meeting my maintenance supervisor joined us and was able to come up with a plan to resolve the tobacco residue that the resident seemed pleased with. *** *** Property Manager La Fontenay III Apartments

While Mr***'s lease was terminated by management July 15, his wife in fact returned the keys to the office the morning of July 16, (at no additional charge)Mr*** did not provide a forwarding address until Tuesday July 21, via email, days prior to vacating the apartment
The only contact I'm required to have with a previous resident is the Statement of Security Deposit Account, which is a statement sent to previous residents detailing any additional charges or deposit refund amountsMr***'s Statement of Security Deposit Accounts was processed and mailed July 16, to the only address LaFontenay had on file for Mr*** (*** *** *** ** ***), assuming Mr*** had submitted a forwarding address form with the post office, I did not find any issue with him receiving his mailI have attached the Statement of Security Deposit Account along with the first page of Mr***'s resident history which shows during his application transaction, 03/01/to his first move in transaction 03/14/no deposit was ever charged or paid
Based on the information presented and discussed there will be no refundable deposit or non refundable administrative fee refunded, and in regards to the $token of acknowledgement of a mistakeThere was clearly no mistake made, proper resident exit procedure was followed and preformed within a timely manner.
I would like to submit a correction to my first email
Mr***'s email was received days AFTER his move out date of July 15, not prior(wrong wording used)

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Mold was visibly present prior to removal of the drywall, which is why I asked for a certified mold inspection to be completed. To my knowledge, this has not been done. Additionally, because of the nearly 5 months of previous delays, I am not confident in the "estimated" completion date of December 1st for the repairs. I would prefer this complaint remain open until the new drywall is actually in place and a certified mold inspection is completed.

To Whom It May Concern:
I am fairly certain that I did pay a $400 deposit to secure an apartment with La Fontenay a couple years ago.  I am in the process of securing documentation from my bank to prove that fact.  If once I get the documentation and see that that is not the case then I will let this complaint go to resolved status.  Until then I want to keep the complaint stand open.  Thanks.

From the period of 6/20/13 – 9/19/14, the residents occupying [redacted] contacted the  LaFontenay office for five plumbing related calls.  The maintenance team responded to each of these calls and contacted[redacted], Inc. for assistance on two of them. ...

Over the past two weeks, the Louisville area was faced with extreme weather conditions. First came Winter Storm Octavia, followed closely by the Siberian Express which dropped our local temperatures to below zero levels not seen in Louisville since 1994.  Heavy amounts of snow and ice resulted in frozen drains that led to leaking roofs.  Contractors were called for assistance and the process of removing the snow and ice from the roofs began as soon as conditions were conducive.
Roof repairs throughout LaFontenay were completed as of Saturday, 2/28/15.  Crews are in the process of completing interior drywall repairs.  The targeted completion date is 3/15/15.
Extreme weather conditions led to the situation that impacted the residents of [redacted].  The inconvenience to them was acknowledged via a $250 reduction in rent for the month of March.

[Provide details of why you are not satisfied with this resolution. Please respond here ONLY]
I did not intend to imply that there was an up charge as a result of being across from the clubhouse, as we explained to Ms. [redacted], what was meant was that we took into account all the amenities that were promised in the cost of our rent.  As you are surely aware, there are many options with regard to renting an apartment in Louisville, we specifically chose this apartment complex because it did offer the hot tub.  Ms. [redacted] explained that the hot tub has been broke since she started working there over a year ago; however, the hot tub (spa) remains on the website as an amenity (see attached file).  If we had been informed that the hot tub would not be accessible prior to signing our lease, we would have without a doubt chose another apartment complex, something undoubtedly cheaper.  I therefore, am making the reasonable request for a reduction in rent of $50/month, retroactive, and until the hot tub is repaired.

Regarding the offer of providing me with first access to the hot tub when repaired, this is not something I am requesting, it is promised to all the residents and therefore should be accessible to all equally.
