Salutations, [redacted] purchased a Volkswagen Passat from our dealership on 31-AUG-for a cash selling price of $18, At the time of purchase, Ms [redacted] also elected to add a service contract to the loan ride La Crosse secured for her through Credit Union Ms [redacted] also elected to have all of her state and local taxes and registration and dealer fee financed into the new loan.The dealership secured said loan for Ms [redacted] after submitting her credit application to two separate lenders: Westby Credit Union Credit Union.The dealership does offer every customer the opportunity to sign up for automatic payments through a third party: Smartpayment Plan.Ms [redacted] was offered the opportunity to sign up for the above stated smart payment plan when she signed out on the final paperwork for her loani.ethe bank contract, purchase contract, MVform, assorted internal dealership paperwork etc.As Ms [redacted] stated in her complaint, there is a charge for signing up with smartpay of $to be paid gradually to smartpay over the course of the loan It would not be charged as a one time payment fee.The dealership does not try to hide this fee form any of our customers and has each customer sign forms stating they understand they will pay this fee over the course of the loan and that they want to enroll in the smartpay program.Ms [redacted] DECLINED to sign up with smartpay at the time of purchase.Ms [redacted] does NOT have a account with smartpay and was not, and will never be, charged by smartpay for maintaining a account with them Ms [redacted] was never charged for this service and there is no fee for said service on any of her bank paperwork.The dealerships position is as follows:We will not pay Ms [redacted] $for a fee to a 3rd party vendor that she declined to sign up for She was not tricked or forced into any contract, and in fact, refused to sign up for said service She was never charged a $fee for signing up with smartpay and will not, and can not, offer any proof that she was ever charged said fee

To whom it may concern,The dealership received the contract back from Wells Fargo this morning, 07-FEB- We will be mailing the title and a check for the down payment out today now that we are assured that this deal is 100% unwound with the lender.We would like to thank Ms [redacted] for her patience in this matter as we understand that it took longer than she anticipated for the store to back off all of the legally binding documents she signed to purchase a vehicle and to get the bank to return the contract.Cordially, [redacted] General Manager

To whom it may concern, As stated in our initial response to Ms [redacted]'s complaint, and as acknowledged by Ms [redacted] herself:  Ms [redacted] declined to sign up with smart payment plan at the time of her purchase.  She does not have a account with smart payment plan because, again, she had never signed to accept the service.  Because she does not have a account with smart payment plan, there would be no paperwork trail to follow, it is simply as service we offer all of our customers.  In addition, the $399 fee for smart payment plan was not entered onto any of the contract paperwork.  It is a fee that smart payment plan charges directly, and gradually, over the course of the loan and is directly withdrawn from the consumer's ACH account.   We can assure Ms [redacted] that she was never charged the $399 fee for signing with smart payment plan. Moreover, after reading Ms [redacted]'s response to the dealership's stance on this matter, and re-reading Ms [redacted]'s original complaint, we believe there is a misconception on her behalf as to the fee we believe she is referring to.In the original complaint and in the response to the dealer's reply to said complaint, Ms [redacted] continually refers to a $299 fee for smart payment plan.  As we have stated; the fee for smart payment plan is $399, not $299.  Also, as we have stated, the fee for signing with smart payment plan would not be printed on any of Ms [redacted]'s contract paperwork.  There is, however, a dealer service fee of $299 that is applied to every one of our vehicles.  This fee is listed on every "Motor Vehicle Purchase Contract" and is also listed, clearly, on every Wisconsin Buyer's Guide.-The fee is listed on the "Motor Vehicle Purchase Contract" on line b. "Services Fee" inside the box labeled "PRICE OF THE VEHICLE" on the right center quarter portion of the contract.  This fee would be printed as $299 on the contract.-The fee is also listed on the "Wisconsin Buyer's Guide" and can be found on the right hand corner under PRICE OF VEHICLE.We are confidant this response should clear up what we believe is a misconception of Ms [redacted]'s of being charged for declining to sign up with smart payment plan.Additionally; If Ms [redacted] would like to come to the dealership, with her paperwork, we would be more than happy to go through it line by line with her.Cordially,[redacted]General Manager199ride Lacrosse

To whom it may concern, Ms [redacted] did indeed purchase a Jeep from our dealership.  She signed all legally binding paperwork (MV11, Purchase Contract and Bank Contract, along with other dealership assorted forms) in house with the help of a State of Wisconsin licenced dealer representative.As Ms...

[redacted] states:  She came back to the dealership two and a half business days later demanding that she be allowed to return the vehicle she purchased and demanding her title and cash down payment.It was explained to Ms [redacted] that she had signed legally binding documents to verify her purchase of a vehicle.  It was also explained that the dealership had already sent all of the paperwork out to her lender, and her title and cash down payment were no longer in house to return to her.After a hour or so of back and forth the dealership was able to contact her lender and put a halt to the bank finalizing and funding her loan.It was explained to Ms [redacted] that it would take some time to get her title and down payment minus 5% of the cash purchase price back to her as the bank had to receive and then send back her documents before we would be able to unwind her purchase.Ms [redacted] can rest assure that the dealership will return her title and her cash down payment minus 5% of the cash purchase price back to her.  If she would like us to send it to her via certified US mail, we would be more than happy to do so at her expense of the shipping cost.Cordially,[redacted]General Manager
