Kubota Credit won't send the finance documents. They did not send payment information on the account despite my requesting it in a timely fashion by voice message since I could not get a real person on the phone. I finally called the dealer from who I bought the tractor only to be informed of late fees. Kubota is a great tractor but there may be other tractors with much better finance companies.

My mother passed away on 8/4/18. She had financed a Kubota tractor in 2017. By the end of August, I had sent Kubota a copy of her death certificate and notified them that she will have an estate. No one informed me from Kubota that the tractor would not be apart of the estate or that I needed to take over payments to avoid her account going to a collection agency. By October, Kubota had sent her account to collections. I dealt with a harassing collection agency for almost 2 months then decided to get my lawyer involved. The pay off on the tractor at the time of her death was ~$14,000. The collection agency was telling me my options were to pay ~17,000 ($3,000 in fees) or let them come and repossess the tractor. It wasn't fair for me to pay $3,000 in fees for a contract I didn't sign for a tractor that wasn't mine. I also knew that if they came and repossessed it, then it would sell at auction for nothing, then they would come after the estate (which I am in charge of) for the rest. The collection agency claimed that Kubota would not waive the fees.

Twice I called Kubota to ask them about this issue. First I was told I could bring the account up to date and take over payments. In order to do this I had to talk to someone specific. When they finally called me back, she informed me that since it was turned over to the collection agency, there was nothing they could do.

After a couple more harassing phone calls from the collection agency, I was going to bring the account up to date, take over payments, and pay the fees. I figured in the long run, paying ~$3,000 in fees was less than what they would come after the estate if I let them take it and sell it at auction.

I decided to call Kubota one last time to discuss my mom's contract. No one had explained what these fees were exactly. I saw no where in her contract about fees except for a late payment and the only interest rate mentioned in her contract was 0%. When I called this time, I was given the option to bring the account up to date, take over payments, with NO extra fees.

I dealt with this situation for an ongoing 3 months. All while dealing with the grief of losing my mom and dealing with other things with her estate. It was extremely stressful and gave me anxiety. This is not something anyone should have to deal with after losing a loved one. I am glad I was able to get things figured out in the end but I think it was by pure luck. I can't imagine how many people just give up trying and end up paying all these unnecessary fees. I am sharing my experience in hopes it could help someone else.
