Mr [redacted] and his psouse attended a Help Your Diabetes (HYD) event hosted by Kristine Burke MD on Thursday, March 12, Mr [redacted] and his wife both signed up that evening for a Consultation (see attached copy of signed Consultation Form.Mr [redacted] met with DrBurke on Monday, March 16, The seminar Mr [redacted] attended expressly discussed the use of nutritional supplements in the programAttendees are told that supplements are used to restore healthy nutrient balance in the body during the program and clients are taken off these supplements at the conclusionDuring the one-on-one consultation with DrBurke, she reviewed the plan components including the use of customized supplements, so Mr [redacted] was well aware of that aspect of the program before signing the contractAfter meeting with DrBurke, Mr [redacted] decided to join the HYD programHe signed a 4-month Wellness Plan application as well as our Wellness Program Policy (copies attached)Within the Wellness Program Policy there is a "no refund" policy which was initiated and signed by Mr***At this visit on March 16, Mr [redacted] was given the HYD starter kit and met with DrBurke as well as our Health CoahcHe also enrolled in the online access to the program and has received all weekly program materials since that date.Mr [redacted] did return the starter kit on April 3, 2015, but per FDA regulations, this kit had to be discarded and could not be resold by our practiceMr [redacted] was not told that it was against state law to accept supplement returns, rather he was told that we do not accept returns because we cannot resell the productThe practices of other retailers is not relevant to our stated policy, signed and acknowledged in the contractWe advised Mr [redacted] that he would be required to pay for the starter kit returned as well as the Doctor's time and services received for a total of $1,even though the contract clearly states that "I agree to waive any right to rescission or cooling off period and agree there will be no refunds, because I have committed to complete the HYD program and follow the recommendations." Review: My wife and I went for a consultation and decided I would purchase a diet program from her for $3995. I was asked to initial a form in 1 area and sign the bottom. Upon leaving, they gave me a box and said that I need to take it home with me. It contained a c.d., a jar of supplements, and a small jar of something. My understanding of this program was to get me off of diabetes pills and here I'm supposed to take more pills. I called 3 days later and told them I had changed my mind. They said that where I initialed was a no refund policy. They didn't say that orally and then told me that they would credit me everything but the box of supplements, which I would be charged $1800. They refuse to credit my m/c card for the whole amount.I returned this, nothing in the box was ever opened and they said it was against state law to refund any money for supplements once they were sold. I just returned a box of supplements back to [redacted] that my wife had tried and had upset her stomach.They credited my card for the whole amount. This doctor is pedaling pills and wants to get rich and the heck with senior citizens. If they would have told me what I would be charged ($1800), I wouldn't have taken them. This doctor is very underhanded. My wife bought into a program while there and decided to cancel the same time that I did. They told her they would credit her charge card back her $1500. I just received a statement and it shows her charge hasn't been credited either. Can you help us out.Desired Settlement: My charge of $3395 and my wife's charge of $1800 credited back to the original credit cards.
