KPHS Roofing

I paid Josh (the owner of the company) half the deposit for roofing material on April 13, 2020. When writing Josh the check I had ask him a few different questions. 1st question - How many days will this job take? Josh response - 2 days at most but more likely 1 day. 2nd question - When will this job be started and completed? Josh response - It's Monday and if the weather stays nice, should be this Thursday. He cashed the check that evening and a week went by with no communication. I texted him about the job and he responded with a excuse about the weather. The weather was only cloudy, the roof could have been completed. There were days when the weather was nice and sunny. After a few messages back and forth, he stopped because I gave him a valid alternative and he couldn't avoid it. Now its almost 4 weeks and I have texted him on 4 different occasions, I have called him on 4 different occasions leaving only 2 voice mails. I have asked for updates and he hasn't responded. I now want a refund because my roof has to be replaced soon.
