The Koko Fit Club advertised a 6-Week free boot camp challenge at their facility. There ended up being a charge to participate in the Challenge, totaling $***. Once you complete a Successful Challenge, you are supposed to get your money returned.
Successful Challenge - weight loss of 25lbs. or 6% body fat
- attending a minimum of 3 workouts per week
- weigh in weekly
- give positive reviews of their Club
Within a couple of hours of signing the contract, I had reviewed the financial end of things and made the decision that this was not affordable within my current budget. I sent an email and a text message notifying that I had changed my mind and I was no longer interested in participating in the Challenge. I was informed (verbally via phone) that because I had received a nutritional consultation, I was not able to get my money back ($*** - initial payment)as I had signed the contract. The nutritional consultation consisted of a 5 minute discussion for a basic meal plan and being handed a single sheet of paper. At the time I signed the contract, it was not explained to me that if I changed my mind prior to actually/physically starting the Challenge, that I would not be eligible for a refund.

Potential customer came in for an orientation for our 6 Week Challenge. She went through the tour and interview and decided that she wanted to proceed with the challenge. She proceeded to fill out paperwork; signing that she understood the contract. We gave her information that only our Challengers receive regarding dieting / meals.
She later called and said that she did not want to do the challenge and our staff originally told her that there wouldn't be refunds given, as the contract states. *** & I (as owners) have decided to refund Challenger the money to resolve the issue.
(The consumer indicated he/she ACCEPTED the response from the business.)
They have agreed to refund me the full amount of money that was paid. That is what I was asking for.
