To Revdex.com: Here is a brief summary of the home build history.
Their loan closed on 4/29/in order to purchase their land and start the process which begins with a set of plans and permitting. Beyond permitting, this couple also needed a Unified Development Agreement (combining lots) and a variance hearing for changing the setbacks. Additionally, the family was using an outside architect and getting changes made prior to and during permitting. Just to move a window on the plans took two weeksTo get a variance, we had to appear before the city council which only meets once per month and it is a big waiting list to get on the schedule. We had to wait weeks for our appointment/turnWe were finally granted a permit on 11/9/and began construction immediatelywas the wettest on record in Austin history. I'm attaching data from the KXAN weather diary for verification purposes. There were many record rainfall days, days with flood gates open and even record rainfall months which equated to a record rainfall year. The worst was in August of 2016. The a*** where the home is located experienced 12+" of rain, the overhang on the entry/garage a*** filled up like a bath tub and fell off the house. This is because the stucco crew had come through and done their job, but the metal roof guys had not done their part yet. We had to place a claim through our builder's risk and rebuild that portion of the home. To Mr***: You state that promises were made and yet the contract was followed. Mistakes were made, yes, we do not claim to be perfect. Mistakes were corrected. Yes we mistakenly put gas in the home because it was in the initial contract. We forgot that a change had been made. We made it right and switched it back to all electric. The roof did not leak for months or get on the sheetrock for months as stated. The sheetrock got wet in one a***, on one occasion after a plumber had come to the home and put in a vent pipe. The overhang fell because the home received 12+" of rain in one night. The stucco guys had done their part on the overhang but the metal roof guys had not done their part. It filled up like a bathtub. We corrected it all. It was immediately corrected. You state that 50% of the home was not as planned. I will attach the blueprints and a photo of the home. This is not the case. The contract does list ***sonable time to construct as months "depending on weather and other factors." The wet bar mentioned was not in the contract, but something discussed after the home was framed as a possibility. It was not a possibility due to the electrical runs required. Gutters were not included in the contract, see attached. We would like to see proof of pricing being shifty. We have never changed our price or our contract. We have never requested additional funds. Obviously, we are sorry the family has not had a better experience. We can't control the weather. We can't control city government and outside architects. We did build them a beautiful story home. We never charged them any extra amounts, even though many of their allowance items were over budget. Our contract price on the home was 353,and we never charged a penny more. They have it on the market currently for 649k so they stand to make a large profit. We are sad that they are getting a divorce and wish they had moved into the home as planned

I am rejecting this response because: These are just excuses. The same type we received the entire process, but usually they were more aggressive and or just ignored our communications. The entire project was managed poorly if hardly ever. As noted, the original "contract" was never adjusted to everything we had verbally agreed on. Case in point how they noted they dismissed everything we asked for before we even broke ground like the wetbar, wood ceilings and etc. The wood ceilings were in all of the renders from KLM. They never took notes in our meetings and we only had 3. SO the things we did discuss were always "forgotten".It is true we had to gain permits, variances and etc. I'm not considering that in this complaint as that is part of the process. I'll even give them 3 months for rain after building, but fact is the house sat untouched for weeks upon weeks when the weather was perfect. The excuse was then... " contractors are getting more expensive and harder to find". So they didn't even have people lined up to do the job. After gaining permits we didn't b[redacted]k ground for awhile which was frustrating, so it wasn't that they hit the ground running after all approvals. I have a picture for proof that shows the ground was not broken until December 18th. I've actually documented and have taken pictures of the entire process.Since gaining permits that November 9 2015 as mentioned, the house is still not complete. It wasn't mentioned but this entire setback has forced us into debt, lost our savings and are struggling to keep up with the builder loan payments that are now $2600/mo on top of the apartment rent. Since we were told and it's in our contract (0-7 months) we only did a 7mo/lease and went month to month as we were told it would be complete by July 2016. I sat in the meeting room where they told my daughter it would be [redacted]dy by the time school started August 2016. That didn't work out so we had to do another 7 month lease. So now we are looking like 16 months out after permits. Weather can not be an excuse and it's insulting that KLM can not own up to their mistakes and bad business.We referred friends to KLM when we got started a few years ago and they have had very difficult times this far as well, but I'll let them tell their story.
