I have reviewed the response made by the business in reference to complaint ID ***.Thank you! The Agent finally returned the escrow However, the time line in which MrKennen claims that payment was made is not accurate If payment was sent on the 17th I should have received it on the 18th All of which was prior signing the release and the submission of this complaint Since MrKennen asserts that the executed release was a prerequisite to sending payment that did not occur on or before the 17th Additionally, regarding MrKennen's assertion that a release against Kennen and Kennen is required in order for them to send the escrowThat is just odd This is not my first real estate transaction In a prior similar situation a *** agent drove to meet me to deliver the check to me, and said he was sorry that the deal was not finalizedNothing was signed to receive the returned escrow check(Only a smile and a handshake) Interestingly, Kennen and Kennen required my signature first in order to receive the return of the escrowKeep in mind this was a dual agency situation and supposedly the agent is not to favor one party over the other The seller could have simply signed an agreement with Kennen and Kennen to release the escrow to me since the Seller was unwilling to address the asbestos, termites, leaking roof, ordinance violations, wiring defects and lead paint It's really the seller that needed to execute a release to hold Kennen harmless for the return of the escrowI have reviewed other local form contracts from another local agentThey do not have arbitration clauses as in Kennen's form agreement One schould consult an attorney to advise them if they want to agree to such a clause in their real estate contractThe West Virginia Supreme Court has struck down similar clauses in form agreements and you may want to strike through the clauseOne schould consult a WV attorney for counsel as to the decision to agree to such a clause in one's individual situationThank you for your assistance with resolution of this matter

There must be an agreement signed by all parties to the transaction agreeing to terminate the contract and most importantly agreeing...
