[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: I will attempt to respond to each of the points argued in the response of Basements Love Us separately: 1) The office did not initiate any call to me to advise me that the work could not be completed I called the salesman, Paul D [redacted] , and left a message on his cell phone when I learned the company was walking away from the job MrD [redacted] has not returned that call even though he immediately accepted my call earlier in the day in which I told him the men were apparently having trouble doing the job I then called the office and spoke with Shannon Shawn B***, who was apparently advising the crew separately, never contacted me or has spoken to me Phone records will reveal the only calls coming in our out of my house are the ones I initiated (except for the initial return call from MrD [redacted] .) The fact that the company has been in business for many years is irrelevant Perhaps, they have just been lucky 2) I was totally professional, albeit frustrated, when I called Shannon and Paul to ascertain what was happening after 3:pm on June 24, It was not until the workmen left my house with the garage door open and the door from the garage to the family room open without notifying us that they were leaving that I became irate and left a nasty message on the voice mail of Basements Love Us The following morning, I faxed the letter I uploaded to the Revdex.com website in which I apologized for the verbiage and tone of my message, but not the substance of such Whatever my message was AFTER BASEMENTS LOVE US ABANDONED THE JOB has nothing to do with the issue of their having abandoned the job without justification 3) Paragraph states: "The Company reserves the right to cancel this contract upon opening of the floor should conditions exist which would prevent the installation, (sic) of a sub-floor system." No one ever concluded that the job could not be done The workman, who informed me that they were not completing the job, told me, "It would take a week to get through the floor and if we can't do it, no one can." The abandonment of the job and the cancellation of the contract had nothing to do with "conditions that exist which would prevent the installation." It was that the job would take much longer than MrD [redacted] had estimated to complete the job Even the workman admitted that it would take too long ..not that it could not be done! I assume the response is from Mr B*** I was there I was talking to the workmen Whoever wrote this response is conveying what he alleges he was told or is simply making up information to justify what his company did, or rather failed to do 4) It is true that the crew arrived with two electric jackhammers; however, within minutes, one of the men brought one back to the truck and complained to me that the earlier crew got the "good equipment" and "that always happens." That jackhammer never went down to my basement again It is true that the three workmen told me that they were going to Perth Amboy to rent an air compressor They were gone for at least an hour and a half Certainly, it did not take three men to pick up the compressor Two men could have continued to use the electric jackhammer in the hope of making progress in my basement Later on, only one man returned the compressor to the rental company while the other two cleaned up They began using the compressor and jackhammer at approximately 12:and stopped at approximately 3: I hardly think that the small amount of time that they were actually trying to penetrate my floor was too long Additionally, there were three men and only one jackhammer at that time They also told me that they got to the dirt under the concrete floor in the area in which the sump pump was to be installed That is why (I assume) they started jackhammering the area along the front perimeter of my basement wall adjacent to where the sump pump was going to be installed 5) Renting equipment may be in their business model, but I hardly think looking for a tool rental place from which they had no previous knowledge or experience is a good business practice (One workman asked me if I knew of a tool rental place nearby When I told him about [redacted] in Sayreville, he told me that his boss found one in Perth Amboy.) The contract provides for an additional fee if a compressor were needed at the jobsite The workmen should come with one ready to be put into action, if needed The homeowner should not have to wait while the company tries to find a tool rental company from which they could rent a compressor Additionally, compressors come in many strengths A quick Internet search for an air compressor in Perth Amboy, from where I was told it came, shows compressors being available for rental from CFM to CFM (CFM stands for Cubic Feet per Minute which determines how many tools can be run from such and how much power the compressor is going to provide.) Perhaps, the compressor that was rented was insufficient to get through the floor and a stronger air compressor was needed The company and its workers should know what equipment is necessary to complete the job for which they contracted The strongest compressor should have been rented since the men had already determined my basement floor to be difficult to penetrate with the equipment they brought to my home 6) It is interesting once again that the person who wrote this response indicated that the floor had not been penetrated If the floor had not been penetrated, why would it be necessary to re-cement such? The person cementing took approximately two hours to re-cement "non-penetrated" areas Additionally, the conclusion of the author of the response that no structural compromises were made to the foundation is without merit He was never in my home, either before or after their destruction of it I have pictures that show the areas that were penetrated now have standing water or visibly damp spots surrounding such They were not there before Basements Love Us came to my home and destroyed it and left 7) Finally, last night I faxed a letter to the company and asked for its name and contact information of its insurance company so that I could pursue a claim against it for the destruction done to my home Today, I received a response that it would not provide me any information because I was "vulgar to our crew and office staff." My dealings with the crew for the limited time they were at my house were absolutely congenial, even joking with them at times and allowing them to use my refrigerator to keep their beverages cool It was not until I saw that they left my house without even a courtesy notice that they were leaving, had left the garage door wide open and left the door from the garage to the family room open as well that I lost it and left a voice mail message on the company's voice mail The following morning, I admitted and apologized for the tone and verbiage of my voice mail, but not the substance of such I defy MrB [redacted] not to lose his cool when a company comes into his house, destroys such, and then simply says, "but we didn't charge him!" 8) I have two more companies coming to my house today to assess the situation and to provide estimates for the correction to the mess left by Basements Love Us I fully disclosed what happened last week to each company I realize that it can be "just more sales' talk," but each indicated that there are some jobs at which problems occur that cause the company to lose money, but that the profit is made from the many jobs that unforeseen situations do not arise To stay in business, you have to take the bad with the good That is a lesson that Basements Love Us has not learned and is the best reason why they should not be allowed to stay in businessIn conclusion, the Business has made no effort to resolve the complaint All they have done was admit that it was too hard to complete the job, but that since they did not charge me, there was no harm or no foul The pictures previously submitted certainly depict the mess that they left and the attached pictures show water that is now in areas that had previously been dry My home has certainly been "damaged" by their negligence Regards, [redacted]

To Whom It May Concern,We performed waterproofing servicesThere was no structural work performed whatsoever When [redacted] originally called our office he called for water leaking into his basement, not anything pertaining to structural issuesIf he had any concerns with structural issues, we would have gladly observed his structural integrity However, he called us out for waterproofing services for a leak in his basement.We performed the work as per the fully executed legal contract We responded immediately to the complaint and there is no further action to be taken on our part We are not obligated to give him a refund as we performed the work the was agreed upon.Regards,Shannon

Again, Basementsloveus is attempting to speak for an employee that they have made it clear has been discharged from their company for his poor workYet nobody in the company other than Paul was there at the timeI regret ever calling this company as they are a complete rip off and completely dishonestThe biggest lesson I have learned is to record EVERYTHING that a company says or communicate only through e-mail because not basementsloveus has lied constantly throughout my interactions with themMy advice to others would be not to let this company come close to your house even if they were to offer to do the work for freeThere is even some possibility that Basementsloveus has made the settling of my house WORSE according to the engineer who came to my house to inspect the current issuesThe job that I now have to get done is costing me $26,The engineer said he won't know for sure but when they get the foundation job done they will know whether Basementsloveus caused this increasingly rapid settling or notBut it is clear that the settling was not at all solved by Basementsloveus which is what I was promised by their now fired employee Paul Regards, [redacted]

To Whom It May Concern:We actually did respond immediately on 3/20/ It appears that it came in as a review and we immediately responded Please see below that I cut and paste from that section.Thank you for your feedback as it is appreciatedHowever, it appears that you do not have your facts in orderYou originally called us for water leaking into your basementWe sent out a representative to assess the situation who sold you a pressure relief system which was the correct fix to eliminate moisture from penetrating inside your homeThe crew advised you that the concrete steps that were hidden underneath of your wooden deck needed to be removed in order to properly rectify the situationThere was an additional charge of only $which covered the removal and hauling of the concrete stair case that was not on your original contract and was an additional scope of work which you declinedWe advised you in order to properly get to the foundation crack this absolutely had to be doneYou advised us that you would wait and see what happened and we have email correspondence indicating the sameAfter a few rain storms, you indicated to us that we were correct and you were still getting waterHowever, you still did not want to pay the additional $for the concrete step removal and haul awayAfter going back and and the inclement weather setting in, we offered you compensation and you declined that indicating that you wanted the work to be doneWe also have email correspondence stating this as wellWhen the weather permitted, we came out and did the additional scope of work at no additional charge to you since you were so unhappy and had to wait for a length of time due to the weatherWhat the other company is recommending has nothing to do with our scope of workWe were hired to eliminate water intrusion onlyNot to do any structural repairs whatsoever and is not reflected on our fully executed legal contractIt is unfortunate that you had a bad experience and the representative who came out is no longer with the company that is why we felt it was necessary to cover the additional costs when legally we were not responsible for thisWe do not appreciate defamation of character, however, obviously you were convinced by one of our competitors to write this unfavorable reviewWe are a very reputable company in our region and perform a very high volume of work.Submitted: 03/20/

Nothing prevented the installation of the system It was simply too difficult for the unskilled individuals to do so with ineffective equipment The workman admitted that "It would take a week to get through the floor and if we can't do it, no one can." There is subsurface water coming up in those areas that did not permeate the floor before That is the reason the cement is not drying Additionally, the workman who informed me that they were abandoning the job told me that Shawn would be contacting me the following day to discuss what else could be done, such as installing a sump near the original wet area of the basement I told that individual that ironically that is what I wanted originally, but their salesman indicated that the correct "fix" would involve the installation of a water remediation system along the front wall of my home with the sump in the opposite corner from the wet area I accepted his expertise, and now am paying for it Regards, [redacted]

To Whom It May Concern:Again to reiterate, We did not collect any funds from this customer and made every effort with an electrical jackhammer and air compressor which was rented at no charge to the customer to try and complete the scope of work . Unfortunately, we were not able to complete the job and advised the customer after making every good faith effort to do so. As per our fully executed legal contract #7, the company reserves the right to cancel this contract upon the opening of the floor should conditions exist which would prevent the installation of a sub-floor system. Since the jack hammer did not penetrate through the concrete slab, there would be no new water sources. Drilling a hole during inspection, is not the Standard Business practice for this industry.We removed all the gravel, sand, and debris from the job site. We acknowledge and understand the customer's frustration, however in this case it could not be avoided.We rarely experience this type of problem, however, in this case the job could not be completed and they can feel free to contact another company and the outcome will remain the same.Please see the enclosed letter indicating that we are sending this matter to our attorney which was faxed and emailed to the customer.  We will not be responding to this matter any further.Basements Love Us, Inc.

try and complete his job but it was not able to be performed.  We have been in business for many years and have performed thousands of jobs and on occasion this can not be avoided.  Unfortunately, [redacted] became irate and verbally abusive when he was advised that we could not perform the job so the call was terminated.  We have retained a recording of one of his messages.Per the enclosed fully executed contact #7 our company reserves the right to cancel this contract upon the opening of the floor should conditions exist which would prevent the installation.  Our crew came out to perform the course and scope of work with two electric jack hammers and one air compressor which we rented at no charge to the customer (reference #20 on contract which conveys there will be a charge if required) as the foreman determined that an air compressor was required.We have been using electric jack hammers and air compressors for years.  We rented an air compressor in one more attempt to try and complete the scope of work.   We had the appropriate equipment to perform the job but the thickness of the concrete made it impossible to penetrate.  Unfortunately, after making a good faith effort to complete the work, it was determined by the foreman that they could not penetrate the floor.  Since the floor could not be penetrated, there would not be any additional water sources getting in the floor.  There was no structural compromises to the foundation.The customer suggested that we drill the floor, however, it is not Standard Business Practice in this industry to drill the depth of a floor during an inspection.  Additionally, our contract states that any items that are moved are the customer's responsibility to put back.We will not be coming out to perform the scope of work and the customer will find that even with a second opinion the outcome will remain the same.It is unfortunate and we acknowledge and understand his concerns, however, we legally do not have to perform anything additional.

additional fee if a compressor were needed at the jobsite.  The workmen should come with one ready to be
put into action, if needed.  The
homeowner should not have to wait while the company tries to find a tool rental
company from which they could rent a compressor.  Additionally, compressors come in many
strengths.  A quick Internet search for
an air compressor in Perth Amboy, from where I was told it came, shows
compressors being available for rental from 5 CFM to 1600 CFM (CFM stands for
Cubic Feet per Minute which determines how many tools  can be run from such and how much power the
compressor is going to provide.)  Perhaps,
the compressor that was rented was insufficient to get through the floor and a
stronger air compressor was needed.  The
company and its workers should know what equipment is necessary to complete the
job for which they contracted.  The
strongest compressor should have been rented since the men had already
determined my basement floor to be difficult to penetrate with the equipment they brought to my home.

It is interesting once
again that the person who wrote this response indicated that the floor had not
been penetrated.  If the floor had not
been penetrated, why would it be necessary to re-cement such?  The person cementing took approximately two
hours to re-cement "non-penetrated" areas.  Additionally, the conclusion of the author of
the response that no structural compromises were made to the foundation is
without merit.  He was never in my home,
either before or after their destruction of it. 
I have pictures that show the areas that were penetrated now  have standing water or visibly damp spots
surrounding such.  They were not there
before Basements Love Us came to my home and destroyed it and left.

Finally, last night I
faxed a letter to the company and asked for its name and contact information of
its insurance company so that I could pursue a claim against it for the
destruction done to my home.  Today, I received a response that it would not provide me any
information because I was "vulgar to our crew and office staff."  My dealings with the crew for the limited
time they were at my house were absolutely congenial, even joking with them at
times and allowing them to use my refrigerator to keep their beverages
cool.  It was not until I saw that they
left my house without even a courtesy notice that they were leaving, had left the
garage door wide open and left the door from the garage to the family room open
as well that I lost it and left a voice mail message on the company's voice
mail.  The following morning, I admitted
and apologized for the tone and verbiage of my voice mail, but not the
substance of such.  I defy Mr. B[redacted] not
to lose his cool when a company comes into his house, destroys such, and then
simply says, "but we didn't charge
him!"

I have two more
companies coming to my house today to assess the situation and to provide
estimates for the correction to the mess left by Basements Love Us.  I fully disclosed what happened last week to
each company.  I realize that it can be "just
more sales' talk," but each indicated that there are some jobs at which
problems occur that cause the company to lose money, but that the profit is
made from the many jobs that unforeseen situations do not arise.  To stay in business, you have to take the bad
with the good.  That is a lesson that Basements
Love Us has not learned and is the best reason why they should not be allowed
to stay in business. In conclusion, the Business has made no effort to resolve the complaint.  All they have done was admit that it was too hard to complete the job, but that since they did not charge me, there was no harm or no foul.  The pictures previously submitted certainly depict the mess that they left and the attached pictures show water that is now in areas that had previously been dry.  My home has certainly been "damaged" by their negligence.

I am rejecting this response because:Basementsloveus continues to reiterate this nonsense line that "[redacted] was only promised a water leakage solution". They are correct in saying that I  only called them about a water leak. I have said that in my own messages. This does not negate the fact that their employee Paul advised me that there was a settling issue and that the drainage system would solve that issue. Does it really seem logical that I would call them about a mere leak and then agree to a $4650 job without any serious issue other than the leak being discussed? Again, Basementsloveus is attempting to speak for an employee that they have made it clear has been discharged from their company for his poor work. Yet nobody in the company other than Paul was there at the time. I regret ever calling this company as they are a complete rip off and completely dishonest. The biggest lesson I have learned is to record EVERYTHING that a company says or communicate only through e-mail because not basementsloveus has lied constantly throughout my interactions with them. My advice to others would be not to let this company come close to your house even if they were to offer to do the work for free. There is even some possibility that Basementsloveus has made the settling of my house WORSE according to the engineer who came to my house to inspect the current issues. The job that I now have to get done is costing me $26,000. The engineer said he won't know for sure but when they get the foundation job done they will know whether Basementsloveus caused this increasingly rapid settling or not. But it is clear that the settling was not at all solved by Basementsloveus which is what I was promised by their now fired employee Paul.
