Kain Construction was hired to construct a small deck, replacing the original deck on our house. We contracted with Kain in mid-August and it was in the paper work that the removal and installation of the new deck would begin around August 15, 2018 and be completed by September 1, 2018. The deck wasn't even started until mid-September and it still isn't totally complete. Benches were to be built to replace old benches and it took several complaints to get them even close to acceptable. One bench still has problems with mitered corners not meeting and holes in the bench where screws were installed but not plugged and so water will get into them and rust the screws. On September 29, *** came to the house for final payment and assured us that he was a man of his word and that with a bit of research he would find the materials to plug the holes and he would see that the corner was repaired so the miter lined up. We paid him for the work, wanting to trust him, but now several weeks later and definitely past the contracted finish date, the work is still not satisfactory.
Before we started the project, we adjusted our contract down to meet the customers budget.
We did start the project late as the complainer indicated. We did more work than the contract stipulated. the underside of the deck was very rotted, so we added labor and materials to correct the situation to make the client happy. That also, was a bad choice. I admit some culpability here.
When I came to get the final payment, the customer shorted the payment by $1,420.00. I was going to let that go. I will now have to lien the property as stated in my contract to get final payment.
Every story has two sides. We have many customers and most of our projects turn out great. This was a bad situation for both sides. I have no malice toward the client.
I hope Tom can enjoy his new deck. We gave him a good job in the end and a good value as well. As much as he denies shorting my final payment. I maintain he did.
I hope Tom and Debora can get over their unhappiness with me. After the first complaint, we made repairs as directed. To someone reading this, how would you feel if someone shorts the bill and takes as first option, a public complaint and not just pick up the phone and ask for what they need? I do not see a win here for either party at his point. Tom is unhappy and I am not fully paid.
Again, I hold no grudge with Tom or Debora.
