The five year warranty issued to the client was a warranty for workmanship, the solar fan product was not covered under the warranty issued. The construction work done has never been in question and to this day there has been no failure or leaks to the roof mounting installation.

I am rejecting this response because: The crux of the issue is that the Business pulled a switcheroo on the fan that was selected and approved by the Community Association.  I confronted the Business's agent, Daniel N[redacted], who gave me his assurance that the new fan was a superior product.  I don't think  the fan failing in a 5 year period constitutes a superior product. The Business also set a precedent by replacing 3 failed fans at it's cost but is refusing to replace the 4th fan that failed. The Workmanship Warranty, paragraph 6, states that "Warrantor further agrees that warrantor will take any necessary action to correct such defective conditions within 14 days  of receipt of notice.  If such action is not taken withing 20 days , the Owners may, at their option contract with another party for the correction of the defects.  Warrantor agrees to pay any expenses incurred by Owners to correct defects covered by this warranty."  Business never responded to notices provided and Owner contracted for repairs for which it is seeking reimbursement from Business. Note that this specific language in the warranty was inserted in the situation where there was a materials defect.  Business does not provide invoices for materials purchased and this language required that Business assist the Owner for warranty items.  Since the Business failed to respond to notices then it breached its duty under the Warranty.
