The complaint regarding HOA violations and the actions the homeowner took do not match up. The homeowner recieved a violation to remove weeds from ditch. The homeowner then without consulting me choose to completly redo his ditch and bring in new rock. This was not what was being
asked to be done by the HOA to remedy the situation. I was also never made aware of this plan or talked to about replacing ditch prior to homeowner choosing to do this. Sales contract has been honored and any differences of resposibility on other issues has been resolved

I am rejecting this response because:
The violations were for an unmaintained bar ditch, not just weeds - see "2nd Violation" attachment from HOA It clearly states that the issue was not "cured" and that the owner (K&S Development) had "let this go"
The HOA Landscaping Guidelines page (attached) state that "Homeowners are required to maintain the rock free from dirt, weedy plant growth, trash and debris and to maintain the flow capacity of the bar ditch"...not just weeding In this case the builder only applied herbicides to the bar ditch, which is also discouraged by the HOA In fact page of the CRF Landscape Guidelines (attached) also specifies that herbicides be limited to small targeted areas...not entire bar ditches
The builder is misrepresenting himself He and his associate were advised on two different occasions that we wanted this situation remedied First his associate went into great detail about possible ways to accomplish this, then builder denied us stating it was not his problem and he pointed us to the developer for possible remediation
Finally, the attached picture shows the bar ditch during construction and the state it was in that we were left to fix The HOA Guidelines specify installing Bull Rock as a minimum...this was not an "upgrade" as the builder suggests, but it was our remedying the unmanageable mess that was passed onto us If you compare that picture with the HOA Guidelines, HOA email sating it's not cured...I am unclear how this can be contested
