Initial Business Response / [redacted] (1000, 6, 2015/10/26) */ I am very sorry to hear that this customer is so upsetLet me address the above issues First of all we are not dishonestWe have been in business for years, and have stayed in business because we are honest, fair, and do not hide anything from our customersIn fact, we encourage all of our customers to take the car to their mechanic and have the car checked outWe offered this to Ms [redacted] There are NOT huge paint and rust issuesIf there were these issues I don't think she would have purchased the carThe only thing I see from the pictures is a small amount of surface rust that is in the 1/inch ridge on the roofIt is so small that we didn't even see it, and neither did she There is absolutely nothing covered upThere may be a spot that has been touched up with touch up paint that is sold at the Nissan dealershipThis would have been done by the previous owner, as we did not do any touch up work on the car, because we never saw anythingIf we would have seen the small area we would have sent it out to the body shop to be painted This customer looked at the car on 10-5-and drove itShe then came back the next day and purchased the carThere were no issues or complaints from the customer at that timeI believe there were no issues because the items she is complaining about are so small that none of us saw them Now I would like to add a couple of things that she failed to mention We dropped the price of the car $to give her the price she asked for We followed all rules and regulations that are set by the state of Colorado, the Dealer Licensing Board, and the Federal Trade Commission We had her sign the "AS IS" document that is mandatory on every car soldIt is monitored by the Federal Trade CommissionIt is to protect the dealer as well as the consumerIt states that the car is a used car and is sold the way you see itIn other words It is sold "AS IS" According to the law I do not have to repair anythingHowever, we are very honest and do not want unhappy customersIf I had unhappy customers I would not have been in business for yearsWe offered to have the small crease painted at our body shop at our costIt would probably cost her about $She refused the offerWe explained to her that she looked at the car times before she purchased it, and we offered her the option of taking it to a mechanic for a used car inspectionShe declined this option The reason that the Federal Trade Commission has the "AS IS" document is because people sometimes forget that these are USED CARS we are dealing withThere will be wear and tear on the vehicleThere will be worn out parts that need to be replacedThis vehicle is years oldWhich in the life of a car is pretty oldIt was sold in excellent condition, considering the age of the vehicle We purchased this from the largest Auction Corporation in the U.SThe car was sold with a sale guaranteeWhich means the car is in good condition, and guaranteed to not have one single problem over $Therefore, you have a guarantee from a multi million dollar company that states the car is in good conditionThis car was a one owner with a clean carfax report This customer became very nasty on the phone and demanded the we give her the title to the car immediatelyIt was explained to her that our policy is to hold the title for working days after the purchase date when we are paid by personal checkand this has been our policy for yearsWell that wasn't good she then threatened us by stating she was not going to bring in her title for the Buick she traded inshe was very rude and uncooperativeWe finally exchanged titles after we were certain her check cleared the bank In closing I would like to once again offer to have the small crease painted (even though she was uncooperative on the phone) at our body shop at our costThe customer will need to pay the $If the cost is more then $I will be willing to pay the extra amountOnce again this is for repair of the small crease on the roof onlyI must remind you that I am not obligated to maintain the carMaintenance is the responsibility of the owner of the car, not the selling dealerI hope this clears this matter upPlease contact me with any questions or concerns
