Ms*** was in contact with our accounting department via email as of May 10, 2016. On June 2, and June 28, the accounting department emailed Ms*** informing her of mail being returned to our office by the post office. Ms*** failed to respond to either
email and provide a current mailing addressThe records Ms*** provided our company prior to closing stated she would be living in the unit so all mail was sent to the unit address. However, Ms*** also provided a PO Box so mail was then sent to the PO Box but it was also returned by the post office. The Association’s Declaration, which Ms*** has signed paperwork stating she has received and read the Declaration, along with the Illinois Condominium Property Act allow for legal fees the Association incurs to collect a delinquent owners balance to be paid by the delinquent owner. The legal fees were also included in the amount awarded by the judge in the Cook County Court system via an In Rem Judgment. Ms*** provides inaccurate information in that the Association has never recorded a lien against her unit. The Board of Directors and management company cannot change the court system or the ICPA; therefore, we cannot change the collection policy as per MsDavis’s desired outcome. Ms*** has informed our company and the Association’s attorney that she has legal representation; therefore, this matter should be handled between legal counsel should she wish to further dispute the balance
