Hello, Our response to the above indicated complaint is as follows: 1)Notification from resident’s son was received by the management office at Juniper Senior Village on 2/22/at 3:32pm via email indicating that the resident had moved out weeks ago 2) Management responded to
the email on 2/22/at 4:31pm informing the resident that the resident is rent responsible through the 30-day notice and provided the prorated rent amount 3) On 2/22/management sent a move out packet to the resident with move out information including a Notice of Initial Inspection, and a Notice to Vacate form that request information such as the move out date and forwarding address 4) On 2/22/at 5:09pm the resident’s son responded back to management indicting that the move out date would be 2/28/17 5) On 2/28/the keys to the apartment were left in the hour drop box 6) Itemized statement mailed on 3/2/from the management office of Juniper Senior Village providing a breakdown of chargesThe itemized statement was mailed to the last known address because no forwarding address was provided at that timeItemized statement included charges of $for cleaning the apartment including the blinds and refrigeratorIt also included charges for rent of $for 3/1/17-3/16/Although the resident was rent responsible for 30-days the apartment was reoccupied on 3/17/17, therefore they are rent responsible up until the apartment is re-occupied. Refer to CA Civil Code (b) …“A tenant giving notice pursuant to this section shall give notice for a period at least as long as the term of the periodic tenancy prior to the proposed date of termination.” In this case, the lease was a MTM tenancy, therefore the notice would be for 30-days. 7) Refund check was issued on 3/8/17 8) No requests or forwarding address were received from the resident until 3/14/via a written letter from the resident’s son.
