I purchased a 2013 Dodge Charger on Friday March 15,2019 and returned back to the dealer the next morning of Saturday, March 16, 2019. I asked the dealer for my money back due to the car was not working right. The dealers Mr. and *** Terral took the car and informed me that they had placed the car in the shop and The Warranty were going to pay $1000 and he would split the cost with me of $650.00 a piece. He explained to me that the car needed a new transmission. I only had the car one night and returned the next day but agreed to pay the amount after he told me that I could not get my money back and I needed a car. It is now July 2019. I have paid the transmission place $750.00 on my own and he (*** Terral) informed me that he were just going to pay 325.00 and that was. I had to get on the phone and call around looking for the car to pay the people on my own. He did not let me know where the car was. I told him I would not take the 325.00 but pay the half amount. He informed me that the warranty was out because I took to long to pay for it. He never called me on that. The transmission place informed me that it is $2100 to fix. Half of 2100 is 1050. I have paid my half and still no car. I am paying a monthly note on the car of 350.00 where I borrowed the money. I am out of a car and need a ride. He refused to help me with anything now and not even 325. He stated they are out. Please help me. All I ask is that he pay his 1050 half. He took my money and car and assured me it would get fixed but it has been over four months and I am paying car note, insurance, transmission place and still paying Uber and people for a ride to work and grocery store. Please Help Me. Thank You.
Desired Settlement ID: Repair That Jonathon *** of JT's Auto Sale will pay their half of $1050.00 to Transmission Specialist where they took the car to get fixed so that I can get the car I purchased from them on March 15, 2019.
It is true that Mrs. did purchase a 2013 Dodge Charger from us on 3/15/19. However, the car was bought with a slipping transmission. Ms. and the man that she brought here with her to the dealership knew this because WE TOLD THEM IT WAS. The car has a reconstructed title. We did put warranty on the car for Mrs. through ASC Warranty out of AR. The car was not brought back the next day. They called and let us know that the transmission didn't want to shift at all anymore. They did bring the vehicle back that following Monday and we had our mechanic check it out. The transmission fluid reservoir was completely dry. We filled the reservoir and bled the system so there was no air in the lines and the customer picked the car back up a week or so later. Roughly 600 miles later the man that was with Mrs. brings the car back and informs us that the car needs to go to the transmission shop. We(at our expense) got the vehicle towed to Transmission *** in West Monroe that same day. A few days pass by and *** has been able to look at the transmission, and he believed the part that was faulty was an internal speed senor for the transmission. Unfortunately, Sensors aren't covered under the warranty policy. However, a conjoining part would be covered under said policy. So the warranty claim was filed for the conjoining part so that the transmission could still be broken into internally and replace both the faulty sensor and the warranty part. Warranty company denied the claim. Sent an investigator out and did the whole 9 yards and saw that it was a preexisting condition and they would not be covering anything on this car. I talked to *** after the investigator got off the phone with me and *** and I discussed the cost of repairs for cash. The Total would have been $2300. At this point *** hadn't broken down into the transmission or touched it other than scanning the transmission codes and taking an educated guess. I spoke to my warranty rep as soon as I got off the phone with *** and BEGGED him to cut me some slack on this car. He said he could cover $1000 of repairs on it for me because I have done business with him for so long and have an A++ standing, but I would lose my A++ standing with them and my warranties would become more expensive due to them having to recoup damages. I was willing to do that. So, XXXX-XXXX=1300/2=650. $650 I was going to pay half of the remaining balance. I called and told Mrs. this and she said it would take some time to come up with the money and I told her I understand but that the warranty company would only cover this repair until 6/15/2019. I had talked to *** on an unrelated deal, and we got to talking about the Charger deal and he said the Mrs. had brought in some money (did not disclose amount to me) and that he would start breaking down the transmission. On 6/10/2019 Mrs. calls me and lets me know that *** thinks that he can fix it for $650 TOTAL. I told her "Great, that's awesome!". So I call *** to verify and he gives me the same story, that he thinks he can get it fixed for $650. So I honor what I said I was going to do and pay half and cut a check for $325. Several days had passed *** Mrs. comes to dealership on a date that I don't remember and wants a check for $1050. I told her that I didn't have a check for $1050 but I had one for her for $325. She asked me where I got $325 and I ran back through what we had discussed on the 10th and she said I was wrong. I asked her where she got the $2100 number from. She told me it was the original number. I tried explaining to Mrs. the deal again all over, but she wouldn't listed to me AT ALL. Just kept talking over me and I couldn't get a word in edgewise. So I sat there and listed to her vent for a few moments and then she asked me how the warranty company was going to pay the transmission store. I advised her that the warranty company wasn't going to pay anything because the time for the warranty had expired. She demanded a check for $1050, and at this point she had started swearing. My patience was wearing very thin. I told Mrs. that she could take my check for $325 and I explained to her that she had agreed over the phone that is the route she wanted to take. She refused my check or my help and I told her that if she didn't take the check then I wouldn't be issuing another one for any value. After a heated argument (from Myself and Mrs. she told me that she would see me in court. I told her "goodluck" and that was the end of that.
We have a signed purchase agreement that the vehicle was sold "As is- Seller will make no repairs whatsoever" We also have a signed buyers guide "As IS- No Dealer Warranty" also signed " Seller will make no repairs and vehicle has Recon Title"
JT's Auto Sales will not engage in anymore activity or correspondence with Mrs..
I will be forwarding all paperwork to *** which is the consultant that was assigned to this case. I advise that Mrs. do that same to show that all documents are matching.
Thank you and have a wonderful day

I totally disagree with everything *** stated. When he sold us the car he told us that it was just a slight shift from first gear and it was a easy fix and he did not state that it was slipping. He stated it was something to do with wiring. I just received my paperwork from JT Auto sales this Friday, August 02, 2019, since after this response from them. I just received the salvage title in the mail and sell papers all fixed and dated back that day in March. if I had not contacted you all I probably would not had gotten them. I know have to take these to the DMV and try to explain to them why I am late trying to get tags when he had the title and all paperwork in his possession. I have paid the Txxxxxxxxxxx a total of $2500.00 dollars now on my own and he still did not contribute not any. The price went up $400.00 more dollars due to what JT Autosales had first said was a easy fix with wiring was not at all it and it needed a whole new transmission. He told the Transmission people that when he took the car to them. I did return the car to him the very next day which were Saturday as I stated and I have people to verify this. The car stayed on his lot for a while and he told my uncle to come pick the car back up and put 600 miles on the car for him before he can put it in the shop. I were against that due to the car would not change out and it would have to be driven very slow. It had stayed on his lot for a while at that point due to he were waiting on us to put the miles on it and he stated I could not have my money back again. He had a tone as though I had done something wrong and I am the one who is being done wrongfully. I have recently paid the car out this week and transmission specialist told me that they will soon get to it. I do not know if it will be done by next week. *** stated I started swearing on our last conversation we had. Once again his statements are not true. He tries to make me look like I am the bad one when he were the one that blew up once again. I had my elderly sick Mother with me and we had just came from her Doctor visit. I should be swearing due to the circumstances but that is not how I am. He did not know but I recorded that whole conversation on my phone and you can totally hear that he is the one that once again began frustrated and angry and I am very respectful to my mother and even him. I did told him when he become frustrated and walking away that he can pay half of the bill as first agreed or meet me in court when he stated he were done and he is not doing anything. That were his intention all along. I also have the envelope post dated showing he just sent all my paperwork. I do not know if I will be penalized by the DMV and I still do not have a car but I have been paying my car note where I borrowed the money for the car from and my monthly car insurance every month since the day I bought the car from him. After I bought the car I have found out he have done at least 5 people with bad similar experiences. I took my uncle with me to help buy the car due to I am a single woman and know nothing about used cars. I somehow still took a major loss.
I know that I may not get any justice for this. I just pray that NOBODY else has to go through this situation.
