We met at the dock, there was a lot of water in it, appears they attempted to pump themselves. Told him we would have to pump it, unsure of the cost (normally $225), he said do what you have to. We pumped, then towed approximately 4 miles, not 1/2. The charge for pumping was discounted to $150...
instead of the $225. He refused. I told him he didn't have to pay right away, I trusted him to stop by the shop and pay. He never offered any money towards the pumping, don't know where the $30 came from. At this point he owes $150 for the pumping.
I am rejecting this response because: The issue is not whether Mr. [redacted] had authorization to tow the vehicle but the manner in which he handled the process. My vehicle was reported to a completely separate address than where he took it. It is against the law for him to not release vehicles 7 days a week. It is also illegal for him to charge more than one day of storage in the first 24 hours of being in possession of a towed vehicle, and yet he charged $50 dollars for both Saturday and Sunday. It is also a misdemeanor for him to refuse to provide documentation that authorized the tow. I am assuming since he refused he did not have it, if he did not have it then he should have never towed the vehicle. If he did have it and refused/failed to provide it, then he is still guilty of breaking the law as he collected payment and released the vehicle without providing proper documentation. Under the C.V.C., if he is in violation of this in court he will owe four times the initial tow charge which will be $1600. I am merely asking for a refund at this point. If Mr. [redacted] chooses to resolve this issue I will gladly remove the complaint. If, however, he chooses to remain in his position I will be forced to take him to court. If his actions within the court are shown to be criminal rather than just civil, then it will also provide a foundation for a complaint and investigation to be filed with the Sacramento District Attorney's Consumer Affairs division.
Business states that they have contacted the consumer directly to negotiate a settlement that was acceptable to both parties.
