On December 29, 2019, I signed a written contract for snow removal for the period of January 2020 to April 2020. The contract said that *** agreed to clear snow from driveway, stairs and walkways at my home in ***. This contract had 3 names attached to it, *** from J&M General Contracting, *** (who was my main contact) and ***. At the signing of the contract, I had to pay half (125$) of the total cost (250$), which I did. On January 25, 2020, there was an accumulation of 20-25cm that was received in a two day period. On the first day, when it stopped snowing, I texted *** to ask him to let me know when he was going to pass by as I would move my car outside. He texted back “Sorry I have nobody to go to *** to do the driveway”. So, I replied back saying that since it’s still snowing overnight he can come tomorrow and he replied back “No I have no one to go out there to do it”. Realizing that we not be getting serviced the remaining of winter, I asked for a reimbursement”. He proceeded to tell me that the first portion of winter (November 2019 to January 2020) was paid for with the 125$ I paid so no reimbursement and then I told him that my contract only started in January 2020 so, no. He told me that he was a “middleman” and will contract me when he gets any news. I contacted him a few times since, emailed him, posted on his *** page and he has not responded at all. He is ignoring all my communication.
I am writing to inform you reguarding the claim made against my business J&M General Contracting ID# ***
I have been put into the *** for not honouring a contract that had been signed for ***. I had gone to have a contract signed by the client but when she was told the price she had said that it was way to expensive so I left with out any signing of any contract. As of December 6 2019 I had signed all contracts over to ***. It states on the papers I had received from the *** that the contract was signed on Dec.29/2019 and the problem occurred on Jan.25/2020. So I am writing to inform you that I never had any documentation signed was not signed by myself or anyone affiliated with my company so I feel that I should not be responsible for any reimbursment I am sorry that this has happend to the customer here is a list of the contracts that I had taken on and signed over to *** this document that I am sending has my signature and *** if there is any other documentation that is needed from me please dont hesitate to ask
:
I have reviewed the response made by the business in reference to complaint ID, and find that this resolution is satisfactory to me.
I will follow up with *** as all contracts have been signed over to them however please note that your business name and letter head is being signed for all new contracts therefore you can also be liable to these contracts. You should ask *** to remove your name and to stop using your letter head.
Sincerely
