I hired JKS construction after the hurricane due to house damaged. After a year-and-a-half of hiring them, they have neglected my home.
Since the hiring of JKS Construction in period of a year and a half. I have gave them multiple issues that could have been fixed on my house which they have not fixed at all. The only thing that has been completed is mold mitigation and tarps were put on my roof about six months after the hurricane. Which had been leaking ever since and I have contacted them to fix them which they have not. I had a tree spike into my lift station which was lying the ground around the lift station go into the hole along with Rainwater making it run 24/7 and feces overfill the area every time it rained. Insurance has told them and myself many of times all they need is an estimate and it would be fixed. This never got done. Along with my soft water system, needing an entire roof on my house and having water leaks in my kitchen, the entire laundry room wall completely rotted out, both my bathrooms taking in water damage. nothing has been fixed since the hurricane over a year-and-a-half ago. We signed an agreement in the beginning of December for my roof to finally get started. The contract stated material be at my house 3 weeks and start after their of. I had to contact them almost every single day with different company showing up measuring my roof almost every other week sent from JK's Construction. A month and a half to two months later after them not contacting me and me having to contact them every day to find out the whereabouts of just receiving material, I called them to tell them that I was terminating the contract because they did not follow the contract nor did they do any of the work that I requested them to do to my house during the whole duration are the project. I wrote them a check for $19,000 and I have yet to receive a dime back from them. The $19,000 was for half of the roof job which they did not do at all. I agreed to pay for the material even though the material showed up two weeks after firing them. they wanted to charge me $9,000 for roofing material and another $6,500 for breaking the contract. I asked for a complete breakdown of the roofing material because it's price gouging in our area. They sent me a price breakdown for the roof which only consisted of around $6,500. After seeing their mistake of sending me a price breakdown of $6,500 and charging me $9,000 for the material, they sent an email saying that was their price for the material and that I would have to pay more even though it took roughly around 2 months for me to receive the material which was promised in three weeks. Also they tried charging me a septic tank fee for getting my septic tank which I told them many and many a times to not do it because I have a physical hole about a foot in diameter letting everything in and out. They have known this since the hiring of day one. They said they would waive the fee but have yet to give me any of my money back. They will not call me door contact me in any way besides email. I've left them many and many a voicemails and texts which they have not even tried to reach out to me. It can be from days to weeks before. It can be from days to weeks before. It can be from days to weeks before I can receive one email from them. even throughout the whole process of them being my contractor, I would have to reach out to them every week because lack of communication within their company
I agreed to pay for material that did not show up to my house on the agreed contract timeline and also I agree to pay the cancellation fee but I'm not willing to be prized guys for material. They sent me an invoice for $9,000 for material for my roof. I asked for a complete breakdown of the material because the material cost is way too high. The breakdown they sent me was for only $6,500. I would be willing to pay $6,500 for the material and $6,500 for the cancellation of the contract. even though I should not have to pay a cancellation of a contract that they did not uphold.
In response -
Mr. did not have funds to work on his home from his insurance company. This was an issue with many many people affected by Hurricane Michael. We did not receive any funds from the *** until December 2019 long after their contract signing date. We spent considerable time and effort working with their insurance company to get them the funds they needed to work on their home. We received Mr. roof deposit money in December right before the holiday. They were getting a metal roof and metal roofs are special order per the specifications of the home. Due to the holiday it took a little longer to receive the material. It took about 6 weeks to receive the material. Right around that time they decided they wanted to cancel despite permit in hand and material on site. We attempted to save the work and have them allow us to complete the roof. They persisted in cancelling. Our contract states that there is a 15% cancellation fee. We were going to abide by our contract and charge for the material we had delivered as well as 15% of the total amount of the contract. The ***'s would not have received the monies they received from insurance were it not for the time, effort and resources that JKS put into the claim fighting and negotiating with their insurance. Again, they received very little money from their insurance company before JKS started working on their behalf.
We also did not perform any mold mitigation. We provided the ***'s with a contact to perform those services should they choose to use that company. We did send out and pay for a septic service. Mr. knew the septic company was coming because they called him for permission to access the property.
Mr. has since received his funds back less the cost of the material.
