I am rejecting this response because: I have spoken to an attorney and the fact they cashed the checks for December and January creates an implied contract. They should have finished the season. Because they walked away from their obligation I had to go find another service which is costing me an additional $300.00 for the month of March. I believe they should have to pay the additional cost. Also, I sent them a check for the February fee which they again didn't have the common courtesy to send back to me even though I did leave a message on their voice mail requesting they do so. The way they do business is highly unprofessional. I want the February check back and I want them to pay the additional cost of $300.00 to plow the [redacted] driveways. That is only way I will settle this matter.
Sincerely,
[redacted]
Complaint Information:
3.75pt; text-align: left;" valign="top"> Customer never agreed to or signed our contract for snow plowing. Customer wanted us to sign a contract assuming full liability for property and to change our insurance so they would receive a discount on their insurance. Customer paid us in December for 2 months service. We serviced the property for those December and January. As no contract had been signed and no payment for February received or accepted by us, we decided to end our business relationship with the customer. We contacted customer by email, which he acknowledged in follow up e-mails that he received, that we were stopping all service and responsibility on February 6. 2015. After which were received no less then 20 phones calls and as many text/e-mails that berated us and also asked us to "honor" an implied contract.
