The ***'s statement is not trueI did not insist the refund when purchased the frame, instead he offered to refund if I could not find a better frame later on in HIS OWN STORE, not at other storesHe proposed to write the refund note, that's why I decided to buy the frame even I was not completely satisfiedAlso, It's not that I called to ask for the fefund, I stopped by his store to ask for the refund, and he refused to do itWe had a big argument at that time. if he is honest he would remember this

I am sorry that *** feels that she is entitled to a refundWhen she originally came in, I spent 1/hours helping her to pick out a frame, but she couldn't decide and said she would return with
her year old daughterEven with her daughter present at a second visit, she still couldn't decide on a frameAt a third visit, after hour she decided on a Prada frame, but insisted that I allow her a refund if she found a better frame somewhere elseOur policy is store credit only, but to help her on her decision, I told her I would refund her if she found glasses elsewhereI even put in clear lenses at no charge so she could wear the frames over her contact lensesmonths later she returned to have lenses put into her own frameI thought she was coming back at this point to return the Prada frame for a refund, but again she tried on more frames and agreed that the Prada frame looked best on her and she was going to keep themweeks later she called and said she wanted a refund on the Prada frameAfter the amount of time I spent with her choosing a frame and the month delay in asking for a refund, I think the patient is being unreasonable in her request

this is a pic of the broken frames. Not one year old. I did not go in there talking about the lenses, nor did I say I wanted to see the Dr. I asked when the Dr. would be there so I could get a copy of my prescription. She said I'd have to make an appointment. I said I don't want an appointment..I'm not paying for an appointment. I just want my prescription. She took it out of the file and gave it to me. I never told her there was a 'lifetime' warranty on the frames. Whatever changes were made to the lenses have nothing to do with the frames being broken. I was not in there talking about the lenses or my vision..although I haven't been able to see straight since I put the lenses in some crappy reader frames I bought in the dollar store. The frames are not OLD, they are less than one year and are covered under a One year 'medical device' warranty. The manufacturer, Legre even said so. He told me all she had to do was contact him, as a vendor, he would have worked something out. She is a really bad liar. P>S> The story about threatening her etc..is a lie. I yelled at her as I was walking out..sure, who wouldn't..and so what, makes no difference. No harm done to her or her store. She's really not too smart. All she had to do was replace the frames..but now I can take her to small claims court and get back the entire cost of the glasses..because they were rendered unfit to be used in the manner intended..and that was to be on my face in those frames. This is in response to [redacted] complaint.It's unfortunate that [redacted] continues to insist that the new owners are responsible for a patients own frame. Clearly [redacted] has no knowledge on purchasing a business. In preparation to the closing date of Austin Optics, I did register a corporation with the state of New York in addition to setting up bank accounts. Legally the business was not transferred over until the closing date in which [redacted] received payment Prior to the transition, the new prospect owners where on site reviewing records along with documenting equipment. Once again the new owners of Austin Optics, bare no responsibilities on the previous owner. At this point I respectfully request that this matter be closed and [redacted], is not given more platforms to occupy her day with. Once again due to [redacted], belligerent and uncivilized behavior services will no longer be rendered. If needed I have footage of the events in April. Below is a copy of the email [redacted], sent to Dr. P[redacted] where she states that "let me have it" [redacted]

At first her reasoning revolved around the 'lack of warranty' (which is incorrect according to NY UCC law 2 - 314) She then claimed she was not the owner at the time of my purchase of eyeglasses from Austin Optics (August 2016) When it then came to my attention that she had registered with the NYS Department of State as the business owner in July, 2016 I sent this information to the Revdex.com of NY, which after being forwarded to her (the business owner, Iris Al[redacted]) prompted her to claim in her last response that although she is listed as the owner as of July **, 2016..the 'transaction' or transitioning of the business was not finalized until 'closing' - again, alleviating her of any and all responsibility regarding the broken/defective frames. At this point I will take my claim to Small Claims Court and let a Judge decide. Additionally I would like this complaint to be placed on the Revdex.com website. Thank you for your assistance in this matter.[redacted]
