Initial Business Response /* (1000, 25, 2016/10/21) */
Mr. [redacted] purchased a wrecked and not drivable truck from us through an on line auction. He asked if we new someone that could tow it to him so we set him up with a 3rd party that transports trucks for us, [redacted]'s [redacted] to bring it to...
him. This was not part of or any way included in the purchase of the truck.
From my understanding from the 3rd party driver, upon arrival he was instructed by Mr. [redacted] to back the truck into a spot that he wanted it in. He was told by the driver that with his tow device he can't back up and especially can't back and turn without making contact with the grill. He was told to go ahead and try it at which time what the driver had told him would happen is exactly what happened.
As I stated earlier this is a wrecked truck that already had extensive damage all over. The only thing that [redacted] Truck Sales is guilty of is trying to assist him with the delivery of his truck and save him some money vs. the more expensive quotes he was receiving to have it towed. I don't see any way that we should be held responsible for a 3rd party doing what Mr. [redacted] asked him to do which resulted in damage to his truck.
Review: Contractor installed 2 large slide by side windows, the process took 3 FULL days. Contractor delivered windows 8/2/13, weather perfect for 3 days, had appointment to install but contractor cancelled due to personal reasons. Rescheduled for install on 8/9/13, cut out old windows (15 year old home), placed in new windows held by 4 screws each, damaged vinyl siding surrounding windows on all sides of window openings from cutting out old windows. Informed contractor screen for main LR window was warped and bent. Heavy rain storm on 8/12/13 to the west side of the home where the 2 new windows were installed and raw wood/walls are exposed to the elements - water damage observed with supporting window frame board warping. Contractor informed of water damage , mold to interior walls of home is a major issue and concern. Installer followed up 2 days later on 8/11/13, rain again all day and installer addressed only the interior caulking and interior molding installation. Home was not protected by contractors drop cloths or traffic from no shoe coverings - contractor said he had them available but chose not to use, causing a 4 hour clean up from homeowner after leaving the premises for use of garage( due to rain needed to use the garage so electrical tools would not be compromised) and interior of home with no coverings. Contractor continued with excuses to not be able to continue work the following week to finish the outside wrap due to personal reasons even though front west side of the residence was clearly dry from rain from remaining work of caulking and final vinyl window wrap install. Installer stored $15000.00 vinyl wrap bending equipment in my garage for over a week since 8/9/13 to 8/16/13. Final completion of the window install - exterior wrap of the windows took place on 8/16/13. Contractor completed work and again excuses of personal business pressing were given to leave the premises premature to completing all work. Final window install work not completed (windows not washed and screen not replaced) but contractor wanted final payment. Withheld $100.00 payment. Contractor not addressing the damage to vinyl siding or water damage incurred through install delays with water damage from storm. Homeowner cleaned interior and exterior of new windows and specially ordered screen for LR window fell apart - screen detached from frame and center post fell out of position with caution taken to remove and replace. Had 4 windows installed by AHT Windows in previous month and installers were A+++, 2 same size windows installed in 4.5 hours by AHT with additional exterior wrap of 2 additional windows installed and no interior/exterior damage to home even though there was also severe weather involved but AHT sought to seeing that window placement was secured from weather before leaving the premises. As a home owner, this is my primary investment and want to invest and protect it. Contractor, Jack Schingen Construction provided no information to contact manufacturer of windows for warranty claims. Contractors like Jack Schlingen Constuction should not be allowed to use, abuse and destroy a dwelling (home)and expect full payment. I have yet to address the damage Jack Schlingen Construction did to my home., he personally is responsible. No proof of warranty/contact information from window manufacturer provided as promised.Desired Settlement: Window install cost discount for lack of service provided but was charged. New cost of repair to damage for vinyl siding caused by contractor to correct damaged area to match siding color with existing siding.. Inconvenience of time extended due to installer issues - home owner expressed time frame due to job relocation to another state with no regard from installer. Installer guarantee to provide for probable future issues caused by installer for water damage of black mold in the wall structure of home to homeowner and future homeowner. Contact information of manufacturer for windows installed for warranty. Repairs to my home caused by this installer will surmount beyond the cost of the 2 windows he 'attempted' to replace. I would like for the next victim to be fully aware of this contractor.

Response:
I am writing in regards to
the complaint, ID number [redacted]. I was aware of the job in question when a friend
of mine told me of a woman he knew getting a quote on some windows and said it
was way out of her price range. So my friend, [redacted], told me he would contact
her for me to give her a price on the windows. I met up with her and we went
over some literature I dropped off to her involving some sliding windows. We
talked on the phone the next week and she said she would go with me doing the
installation a couple days later.
She then called back and said she was going with the
other contractors that quoted her the price in the first place, and told her
good luck with her windows.
I didn’t hear from her for until 4-6 weeks later, until
our mutual friend told me she was upset with her contractor, and claimed he
broke her door and that she was upset with the work that was done, and that she
did not have the contractor install all of her windows.
[redacted] told me that [redacted], the customer, wanted me to
install 2 windows on the front of her house. I went back and measured up the
front 2 windows. I felt bad the other contractors took advantage of her up to
that point. We went ahead and ordered up her windows, and I informed her that
it would take 4-6 weeks for them to come in and she agreed that that would be
okay.
She called me about 2 ½ weeks later and asked if the
windows arrived yet and I told her I have not heard from them, but I would let
her know when they came in.
When they did come in I contacted her and let her know
and we set a date to install the windows, and she informed me that we could
install them on Friday or Saturday only.
So I agreed. We went to work on the windows. I removed 2
windows from the front of her house, replacing them with the 2 she had ordered,
from Vinyl Replacement United. The old windows
were glued in and caulked around everything. We then told her we would
have to come back next to finish them, and she said we had to come back the
next weekend and finish them and I agreed.
We went back the next week, and it was raining when we
showed up and she said she did not want us to track up her house.. I told her
we could come back the next day, and she said not to and demanded that I stay
and work on the windows, and that we had to wipe our feet each and every time
we came in from outside. She wanted us to also install the molding on the
inside of the house around the window and to reinstall her blinds, which had
nothing to do with the windows and which I didn’t originally agree to install,
but I put them in anyway. I also cut down some floor molding and installed it
around the island in her kitchen that she told me wasn’t installed by another
contractor she was not satisfied with, another thing I did to help her out,
which she wasn’t charged for. It was raining outside, and we had to bend metal
and install around the outside of the windows, so I told her we would come back
to do that because it wasn’t feasible to do in the storm, so we came back
another time and finished it entirely.
She had a problem with her old window, which had led to
mold forming inside the home and they had a mark on the sill. When the person
who installed the windows originally, which I had nothing to do with, put them
in, they didn’t install the J-channel properly. I did not install her J-channel
or siding, so any problems that came from the improper installation of them had
nothing to do with me. I’ve been in the Building and Remodeling business for 35
years, and have never had a customer like her before. After I completed
installing the windows, our mutual friend informed me that she never paid the
other contractor in full, the one she went with on the other windows
originally. The poor job she said they did was the reason I felt bad and
charged her $2800 less than they did, so I don’t feel its right to give out
another discount on this job. I ended up paying myself on this job as it is.
I brought the windows to her house, and they arrived
there without a mark on the windows or the screen, in the same condition from
which I’m sure they came from the factory. We had to do the work on the
weekends, because that was when she’d be there. I wasn’t to be there working at
all when she wasn’t home, so incidentally she was there for the entire install,
looked over the work before we left every day we were there, and never informed
me of a problem until I received a letter from you. The day we did the molding
and the install on the blinds, we wiped our feet and wiped her floor before we
left, and I made sure there was no mess from us whatsoever, because she voiced
that concern before we even started that day. There was no mess for her to
clean after we left, inside or out, on any day we were there working, so there
is no way she ever had to clean up behind me for 4 hours on any of the three
days I worked there. We moved her furniture back, of which a couch was placed
before one window, table and chairs in the kitchen before the other, and the
mess which would have been on the floor was nonexistent.
Every night before we left she looked over our work and
told me she was satisfied with it, then the next day had a different opinion. I
am also in no way responsible for work another contractor had done, and I
believe the many discounts I gave [redacted] already are more than enough
to satisfy anybody, discounts she was given before I ever started working.
