IRC ENERGY SERVICES INC HAS NOT FULFILLED ITS CONTRACT WITH CUSTOMER. FILED COMPLAINT TO CLB, BOND CO. AND SUIT IN SMALL CLAIM COURT
Review: I was first contacted by the Gas Technology Institute in October of last year. I don't remember theperson's name; he was suggesting that I may qualify for an Emerging Technology Program and theEnergy Upgrade California (EUCA). This program will include the installation of an energy efficientheating and water heating system for "almost free" and that a contractor can evaluate whether I willqualify for the program or not. Mr. [redacted], the owner of IRC Energy Services as his cardindicated, came to my house and said I qualify for the program. According to his explanation of thecontract, I can pay IRC $24,990.00 immediately for the system through a 9 months interest freeconstruction loan with GreenSky. After the nine months, if the loan is not paid in full, I will have to pay thepast nine months and the future interest at a rate of 18%. That's over $4000! I agreed to the financingonly because Mr. [redacted] of IRC assured me that within the following 3-5 months I will receive$4500 from EUCA, $2719 from Gas Co, and $6800 in product rebate. With the rebates and the federaltax credit ($7497), I would receive most of the money back by April and would be able to repay most ofthe loan before the nine months.Ten months later, they were still not finished and alii received was $4500 from EUCA and $2719 from theGas Co. IRC assured me the remaining rebate $6800 will be paid after all inspections are passed. In themeantime, the nine month interest free period had past. Had I not paid the remaining $17,700 out of mypocket, I would have incurred over $4000 in interest.The system finally passes inspection in August 2014. The deadline was August 15, 2014. However fourmonths later, they are still withholding the payment of the $6800 manufacturer rebate. I only found outrecently that [redacted] "the owner" is no longer with IRC because of internal disagreement in their businesspractices and that I need to deal with the real owner, Mr. Alex Del Tore. For the past three months I havebeen promised the check is coming but just waiting for authorization from the owner.[redacted]Desired Settlement: Forward the manufacturer rebate, $6800 as promised in the cost break down.
