This complaint is prematureComplainant asked for a refund on February *, on his credit card. We initiated the refund the evening of Feb * for the $deposit plus one of two usually nonrefundable application fees of $by credit card, as per complainant's requestFunds were
taken out of our bank account on Friday February ** by our credit card service provider. Before initiating the credit card refund, we advised complainant that the funds would take longer to process by credit card (business days), and in the alternative, we would be able to mail him a check which could post to his bank account right away. Complainant still opted to be refunded by credit cardSince we had initiated the refund as per complainant's request, we are no longer in possession of the funds, which are being handled by the credit card service providerIn our experience, the refund charges including the credit card service fee of 3% are also refunded to the customer, however, as we had advised complainant, it can take up to business days to see the refund.Finally, the application fees of $per applicant are clearly stated as non-refundable on the deposit agreement and lease application formsComplainant agreed to these terms by signing and dating on two separate forms and rendering payment (See Attachment Broadway Deposit Agreement, also provided in Complainant's Attachments)We began processing complainant's application immediately, and unfortunately the landlord denied his applicationWe do not and cannot possibly guarantee that every application will be acceptedWe did refund of application fees, even though these fees were nonrefundable. Complainant has initiated this public Revdex.com complaint only a mere business days after his refund requestWe had dealt with his request promptly, and are unfortunately not in control over the speed of the payment method he requestedWe also advised complainant that it would take business daysUnfortunately we also unable to reverse the process to cut a check for him, because once we initiate the refund by credit card, we no longer have control over the funds
