*** *** *** *** was detained at the South Texas Detention facility on or about June of 2014, the law office was hired on June 02, to represent him in removal proceedingsMr*** was originally slated by the Department of Homeland Security to be expeditiously returned to his
home country The law office submitted a credible fear request on his behalf on June 03, which allowed him to remain in the United States pending his credible fear interview, normally individuals like Mr*** are immediately sent back to their home country Unfortunately, the current immigration laws only allow a person to be eligible to be released on bond in the United States if, he is determined to have a credible fear of returning back to his country This determination is made after the Department of Homeland Security interviews the respondent and is based almost completely on the respondents testimony
My office visited Mr*** in person on June 05, in *** Texas where he was advised of his rights and what he would expect to be asked at his credible fear interview. *** is an hour away from *** ***, Texas. The United States has and continues to deal with an immigration crisis which caused Mr*** along with countless others to be moved to different parts of the United States, specifically Mr*** was moved to the *** Federal Detention Facility in *** ***
On July 17, we received a phone call from the Asylum officer, this call allowed us to be present telephonically and listen to the credible fear interview. After the interview the officer concluded that Mr*** did not have a credible fear of persecution and or torture and as a result the removal order was not vacated. This meant that the client would be sent back to his home country.
It is my position that we represented Mr*** correctlyThe amount of attorney and paralegal time spent on this case far exceeded the $that was paid to represent him. This is clearly a situation where the contracting party was dissatisfied with the result but it was clearly explained to them that the results of these types of matters can never be guaranteed
