I have been trying to respond to the complaint filed, however I can’t seem to be able to online.. In response to the customers issue. First, we are subcontractors doing work for [redacted], their salesperson sells the fence to the customer, explains the process then turns the job over to us. We then...
obtain permits from the cities, call for inspections, install the fence per code, etc… The city of Euclid requires all fence post holes to be dug to a depth of 39”. That includes any holes that may fall in a concrete sidewalk such as this gate post in question. In order to dig to that depth we have to have a sizable hole in the concrete. We use a concrete saw which of course has a round blade, in order to get a 12”x12” hole in the concrete there are overcuts on each corner which this customer may think were accidental cuts. We then are required by local code to fill the area around the new post with concrete to the surface so that frost will not be able to get under the post and heave it in severe weather. In doing so this post hole now becomes bonded and a part of the actual sidewalk. This customer’s sidewalk actually has a control joint (which is put in usually every 4 feet when the sidewalk is installed to encourage cracking in a controlled area) near the gate post we installed. When the weather got cold this winter the sidewalk heaved (lifted slightly) due to frost, the portion where we put the post did not lift because of the new concrete going down 39” (city code) therefore causing the crack.. I will pay the customer the $150 he is seeking but as you can see we did everything according to our scope of work and according to city code… I mailed out a refund check today.
