I signed a contract for catering services on 3/11/2020 for an event that Horsewood Catering was to provide catering services for in June of 2020. I delivered a personal check as a deposit for services in the amount of $1,642.20 (which cleared my bank on 3/17). On Monday 3/16, Horsewood Catering sent me an email advising me that prep/planning activities for the June event would need to be 'played by ear' due to COVID-19 concerns. After considering the repercussions of this information and the likelihood that they would not be able to provide catering for the June event, I emailed back on Wednesday 3/18 releasing them from the contract and requesting a refund, net of any expenses that they had incurred up to that time frame on my event. At this time Horsewood is refusing to provide for any refund whatsoever citing contract provisions. The contract contemplates not providing services on the event date ('acts of god') or damages incurred. Neither has of these things have happened this far in advance of the event.
Most of the information in this complaint is false. The contract was signed on 3/7/2020 for a wedding that we were to provide services for on June 20, 2020. We received the check in the amount of $1,642.20 on 3/16/2020. On Monday, 3/16/2020, an email was sent advising *** that we received her deposit and that we would tentatively schedule the tasting and never referenced the June event. Our exact words were "We will start scheduling tastings in mid-April as long as everything is good by then". The tasting we were looking to schedule mid-April, which is a complimentary service that we offer. Another email that was sent the same day stating that we may need to push the tasting out to May and we would play it by ear, the reference was never towards the event date. On 3/18 *** emailed us saying that she wanted to cancel the event due to COVID-19 and her mother in law needing surgery. The part of the contract that we are referring to is in Section 3 that states cancellation for any reason whatsoever that the deposit is non-refundable. Because of the situation and COVID-19 and the uncertainty of the future, we offered to be very flexible with a date change. Please see attached email chain and signed contract!
In their response they seemed to indicate they are willing to provide services. I have sent them an email inquiry (yesterday) asking that they do provide the services that they claim they will still provide. I have not yet received a response from them. If they deny my request then this claim is not deemed closed or handled. do you need a copy of my email to them?
Our book keeper has submitted the check request to accounts payable and a check will be sent out within the next few days.
