Real Estate Fraud, attempting to collect a debt on property that has already been paid. Attempts to collect a debt without any documentation, coming by said property harassing the owner for payment. claims of a second loan taken out by owner owed to Home Realty however has not made contact with owner in approximately 3 years but now making contact after learning previous owner is deceased and attempting to receive payment by heirs of the property.Desired Settlementn/aBusiness Response Please be advised the I represent Home Realty of[redacted] in connection with the deed of trust on the real property at [redacted] recorded at Inst. No. XXXXXXXX. A real estate loan was made to [redacted] on June 4, 2007. He passed away November 2012. The loan is in default. When I sent written demand for payment, one of his sons [redacted] called me and said they did not owe anything on the house and that there was real estate fraud and that they had an attorney resolve this matter. I sent a follow up letter asking him to provide details about the fraud or give me the attorney's name. I also talked with one of [redacted] daughters and asked her to provide me further information. No further information has been forthcoming about any alleged fraud. Therefore, this matter appears to be a case of the heirs of [redacted] wanting to live for free in this house they inherited without having to pay the mortgage lien of Home Realty. It does not appear that any further response is warranted until such time as the heirs of [redacted] specify the nature of the fraud. This was a simple real estate loan and nothing more.
