HIGHWAY Sales Inc. A vendor of Dart Transit is trying to prevent me from contracting with another Carrier as provided in the lease under CLAUSE 1 and 10.
As is allowable under the contract with Highway Sales Inc. You must give a 3 day NOTICE of intent to contract with a different carrier.
They also state that: if your contract is canceled with the carrier it is YOUR duty to to contract with another Carrier or return the truck to a place designated by is.
If I were to try and transfer the leass. I would be SUBJECT to a penalty at the rate of 25% of the liquidated loss of the truck.
Highway Sales in an effort to prevent you from leaving Dart Transit tries to say you owe $20,000.00 to transfer the truck as if you are transferring the lease.
When in fact you are not transferring the lease. There is nothing within the contract that enforces such a numeric fee. It eludes to no monetary cost to contract with a different carrier. But in what seems as a conflict on interest with Dart and Highway Sales. Where Highway Sales attempts to either keep you at Dart with that Truck or get you to default on the loan by turning it in.
Most drivers don't read the contract nor is there any Highway Sales Rep at the orientation to hold a Q&A.
They simply rely on the sizzle of the truck and you being an owner oporator.
Then they tell you of this enormous number to go to another Carrier and about liquidated cost. When they sale you a truck with dog hair that you can't get out and 155000 miles on it for full pop.
They fabricate a story as if they have purchased the truck from a dealership. When in fact. The truck came directly out of their own inventory.
They go through 5/3 rd Bank to secure the loan for the truck. Then they "lease" it to you.
When presented with an alternate carrier which would provide you with the opportunity to male more money and get home often.
The obstruct you with a false fee of 30% of the trucks value which once again is not in the contract.
It is an act of consumer fraud and a possible breach of contract by conflict of interest.
