Business owner kept my rent money because I left without a thirty day notice.The services she promised were not provided!
I called owner of horse stable and was told she could provide a safe and sheltered pasture.I moved my on Feb.1,2020 to this facility. The pasture my mare was put in was not safe. On first nite another horse jumped the fence and preceded to harm my horse. I arrived next morning and moved my horse out of the pasture for her safety. She had several wounds that were superficial.She was terrified.The owner arrived and said we should move her to another pasture which we did. This pasture had water and grass but No run in shed from bad weather. Of course it has rained hard this month and I decided that the best thing to do would be to move my mare back home with me. No animal should be left in freezing rain and my mare is thirty five years old. I waited until the eighth for her to calm down then asked the owner to transport her home She did on Sunday Feb.9,2020.I asked for a refund on several occasions however no response was giving.I finally had a mutual friend ask owner to respond to me. She responded on Feb24,2020. She said she would keep my money. $455.00 because I did not give thirty day notice!She however did not provide a safe, sheltered pasture as promised. The rent was 400.00 a month and I had included 40.00 one way shipping fee plus $15.00 worming fee that she requested. I feel like I owe her $100.00 for nine days of rent and two transport fees totaling $80.00. I wish to have the balance refunded as she did not meet the verbal promised safe and shelter pasture. She said not she was abiding by the thirty day notice instead. This is not in good faith and she refuses to negotiate .
Refund balance of $455.00. Rent should be no more than 120.00 for nine days and transport fees are $80.00.Therefore I feel I should be refunded $255.00.
Customer did not want to comply with signed contract.
We chose not to charge her into the following month even though 30 day notice is required (which is listed in the contract) we even waived the transporting fee (contract states Owner has to pay)
Worming (is consistent with recognized standards of care & also in the contract).
We did our best to assist in this situation, this `refund` sought is not considering the expenses that accrue from reserving a spot to board the horse.
This is THE best place to board horses in Tyler. Sally works tirelessly to provide the very best to horses in her care. My horses have lived at High Pointe since 2015 (I currently have three there). Her pricing is extremely fair considering the value offered and the boarding contract covers everything one needs to know while having their horse(s) at High Pointe.
