On Nov19, 2015, a Hendel truck careened into my large, healthy silver maple tree, toppling the tree Instead of having his insurance agent see the damage, Hendel wanted to remove the tree immediately I insisted on having a certified arborist assess the damage, and give a written evaluation of the tree and costs On Dec4th I sent that evaluation to Hendel; it included base value of the tree, grinding of stump and installation of a silver maple, plus arborist's fee, for a total of $I requested payment within days
No reponse: I sent another letter on Jan25, No response His voice mailbox was full, until March 2nd, when I reached him He claimed my tree must have been weak (not true), and all he would agree to was to replace the tree
This is in the parkway, between the sidewalk and curb There is only a 12" space there
so there is no way to replace my 16" diameter tree with anything larger than a 3" sapling!

We did immediately respond to this complaint directly to Ms. [redacted]. We did have many communications within the first couple of weeks as through January and February 2016. I also just contacted her about 3 weeks ago. The tree is not on her property nor is it her tree. ...
It belongs to the street association. We did the removal of the tree immediately at our expense and offered to replace the tree. Our truck did not careen into tree. The tree was not healthy to begin with. The truck brushed the upper branches and the whole tree fell and damaged our truck which we did not seek damages. We are unable to make direct restitution to her since it is not on her property nor does she own the tree. All of this was explained to Ms. [redacted]. I have spoken with [redacted] who I was doing the work for in the area and he did not think that the situation was that serious and replacement of the tree would be more than sufficient on our part.
