Ms. D, owner of Hawaiian Island Rentals, LLC. is completely non-responsive to any outreach regarding refund of stay that did not happen.
I initially contracted for a vacation unit at the Beach Villas at Ko Olina Apt.*** on October 8, 2019 and paid the 1st installment. The contract provided my family to check in March 31 and stay until April 7, 2020.
On October 17, 2019 Ms. D breached that contract when she advised me that the unit was not available April 6 because she had booked another party in commencing April 6. After some discussion I graciously mitigated her liability by agreeing to contract for the unit checking in March 31 but checking out April 6 and finding another place to stay our last night.
In early March the contract became null and void due to the Covid 19 'impacting world health and severely limiting all travel. A National Emergency was declared March 16 and to this day, travel to Hawaii is still subjecting out of state residents to a 14 day quarantine.
Ms. D refused to offer a refund noting in writing that she had to pay for the mortgage and expenses whether her rental was occupied or not. She noted that she could only offer to reschedule for September or October.
Of note, in October of 2017 had booked this same rental through VRBO with Ms. D and had a great experience. Ms. D suggested that this time we book directly through her. Unfortunately, what we did not realize was that we had no safety net, as VRBO would have been who we would work with regarding refund. Ms. D refused on her own.
After rearranging work schedules, on March 20, 2020 we requested to book September 3-9, 2020. Ms. Diaz sent an email confirming that she 'blocked those dates? and would send another updated contract.
I made 4 attempts to contact Ms. D for an updated rental agreement. (5/20, 6/1, 6/2 and 6/8) She did not respond at all. I also sent a message via VRBO on 6/8 requesting the contract and she responded noting she would send one. She never did and is no longer responding to any outreach attempts.
I then sent a letter requesting a refund as we cannot trust that the rental is valid without a contract. Again, no response.
At this time, Ms. D has cashed both checks for a total of $2610.74 for services she did not provide.
We are afraid this is happening to others as well.

Refund We simply want Ms. D to refund us the money owed to us as we did not stay at her vacation rental. We are also very concerned for any others that may have booked through Ms. D as she continues to list this property. Regardless of whether she has a mortgage, it shouldn't be paid by someone who hasn't stayed there. We appreciate your help warning others who this may happen to. A professional business should not be allowed to operate in this manner.

At this time since she refunded us I feel this issue has resolved.
