On 11/27/2018 I flee into FL to buy this 2014 Ford Explorer XLT from GTR MOTORS INC. the week before I was given an approval with $3000 down payment, When I got there they told me they did not know what happened and I had to put down $4500. I put down $2000 on my card and $1000 in cash. we had agreed for me to pay the $1500 between the 12/8/2018 to 12/21/2018. Before leaving the dealership the Key remote did not work, I spoke to the sales guy *** who then took the keys and stated he changed the battery in it. (remote still did not work). Driving an hour out from the Dealership heading to GA the truck Engine light came on and the truck started to shake bad so I pulled into a gas station where the truck broke down. I contacted *** the manager and *** the sales guy explaining to them what happened. the sale guy *** told me he would call me back and has yet to do so. After making it up to GA with the truck *** the manager told me to go to PEPBOYS and whatever is wrong with the truck he will fix even if he has to send me money to pay for it. The codes was sent *** and *** the codes and I was told that only FORD Dealership can fix these code problems. upon speaking to *** letting trying to figure out whats the next move in getting this truck working he told me he is not fixing the truck and then stated the photos I sent him on the codes and the engine light being on was blur. Then he also said he did not got it when my phone stated it was delivered. I told him I will take him to court he Hanged the phone up on me. I have already contacted the finance bank

The Manager and Sale person told me they would have this truck fixed.. The truck started giving me problems before leaving the dealer ship.. he told me 1. he would mail out a key or I can come pick the new key up for the truck. he also stated that they would cover it seeing that in the 1 hour the truck broke down with me on my way back to GA...

Re: CASE # *** 011ivierre
We, GTR Motors Inc, reviewed above complaint against our dealership. Above individual, *** purchased 2014 Ford Explorer VIN#1FM5K7D82EGAXXXXX from our dealership on November 28, 2018. He applied online to get financing for the vehicle and was approved by Westlake Financial. The total down payment for the vehicle was XXXXX, our dealership received $3000 from Mr. on the day of purchase, and we agree on deferred down payment $750 due date 12/08/2018 and $750 due 12/18/2018.
Two weeks later on December 12, 2018 customer called our finance manager stating that the vehicle has mechanical problems and he is not going to pay the down payment balance. We explained to Mr. that vehicle was sold AS IS - NO WARRANTY and customer is responsible for the repairs, however we asked Mr. if the diagnostic was done and if he has an estimate for the repairs. Customer never sent us an estimate for the repairs. Moreover, customer never paid his down payment balance in assigned time, neither did he proceed with finance. Therefore Mr. left us no choice but to repossess the vehicle. The vehicle was repossessed on December 18, 2018.
According to bailment agreement the usage is assessed at the rate of $50 a day and $0.5 a mile. (21 days of usage is $1050; 3639 miles of usage is $1819.5)
According to pre-repo agreement the minimum repossession fee is $750.
In order for our dealership to get the vehicle back, we had to pay for transportation from Atlanta, Georgia $400 and order a new key $200. According to spot delivery agreement all the expenses that incurred from the recovering the vehicle by dealership is customer's responsibility. We need to mention that the vehicle came back in good working condition.
