There is a check box that the customer need to put a check mark to acknowledge that they have agreed with the product terms of service in order for them to place an order. As per our terms and conditions "You are ordering a 60 capsule bottle of green garcinia pro under the 14 day trial offer for $4.95 for shipping and handling. Orders are shipped via the US postal service. If you choose to keep the product beyond the trial period, you then will be charged the full amount of $89.97. Your 14 day trial begins when you place your trial order. If you are not satisfied with your green garcinia pro trial offer, cancel your subscription before the trial period ends. If you are satisfied with your green garcinia pro trial offer, do nothing and your credit card will be charged an additional $89.97 approximately 45 days after you placed the order for your trial shipment. In addition, approximately 45 days after you place your original order for your trial for green garcinia pro, and for every 30 days thereafter, we will automatically send you a 30-day supply of green garcinia pro. The credit card you provide today will be billed $89.97 14 days after your trial order is shipped to you, $89.97 will be billed to your credit card with each successive shipment thereafter."

The customer called us yesterday, September ** to cancel her subscription but he was charged already for two $89.97 which is for the full cost of the Green Garcinia because the 14 day trial that was given to the said product has already ended and the other $89.97 was for the 2nd bottle of Green Garcinia that was shipped to her. To clarify, she was charged already before she even cancelled her subscription. That's why when the customer contacted us yesterday, via phone to cancel the subscription, one of our Customer Service Representative explained why the customer was charged for the said amount and was told that she's no longer eligible to get a full refund since our 30 days money-back guarantee period for her account has already expired because it's been 2 months already and the money back guarantee applies only to the initial bottle and all bottles that was shipped to the customer after the initial order are considered final sales - that is clearly stated on our terms of service.
However, we have every desire to address the customer needs and provide the best solution available to resolve the issue, that's why our Customer Service Representative escalated the customer's concern and we did make an exception to settle the customer's issue. With this, we can apply a discount coupon in the customer's account to provide at least a $50.00 courtesy refund for the latest charge of $89.97 or we can also send another bottle of Green Garcinia for FREE (including the shipping) as a complimentary to resolve the customer's concern. Please let us know which of the two given resolution the customer would prefer.
We already cancelled the customer's subscription to avoid any further charges as requested yesterday which is the first time that the customer contacted us via phone. Rest assured that no more future charges will be taken out from the customers account and no more products will be sent out.

The customer did have an option to un-check the box if the customer did not want to order that, however as we can see in the account, the customer was not able to do that, mainly the reason why the customer received the Ven Cleanse.

However, we have every desire to address the customer needs and provide the best solution available to resolve the issue, that's why when the customer contacted us yesterday, August **, 2014 via phone to cancel the trial subscription, one of our Customer Service Representative tried to explained why  the customer was charged for both products but the customer hung up on us that's why we were not able to resolve the concern during the time when the customer contacted us.
To settle the customer's issue, I will be applying my discount coupon in the customer's account to provide at least a $40.00 courtesy refund in each of the charges which will give the customer a total courtesy refund of $80.00 or we can also send another bottles for FREE (Green Garcinia and Vencleanse including the shipping) as a complimentary to resolve the customer's concern. Please let us know which of the two given resolution the customer would prefer.
We already cancelled the customer's subscription to avoid any further charges as requested yesterday which is the first time that the customer contacted us via phone. Rest assured that no more future charges will be taken out from the customers account and no more products will be sent out.

The customer spoke with one of our Customer Service Representative where he requested to be refunded and our Representative only explained why the customer was charged for the said amount and never threaten the customer for additional charges that might occur instead he was informed that if he's going to file a claim to his bank and this will turn around, he might get charged for accusing us of fraud by his bank since other banks does that. Please be reminded as well that the charge of $89.97 came from the Green Garcinia bottle that the customer originally ordered for $4.95 because he was only given a free 14 day trial for the said product and if he will not cancel the subscription he will be charge for the full cost of the bottle because it's not a free sample, it's the actual product that we sell.
However, we have every desire to address the customer needs and provide the best solution available to resolve the issue. Even though he's no longer eligible for a full refund our Customer Service Representative still offered him the maximum courtesy refund of $50.00 back in his card where the customer also agreed and we already sent an email to the customer's email address regarding the said resolution and we are just waiting for his response that he's accepting it so we can get an approval from our Finance Dept. to issue and process the said $50.00 courtesy refund immediately.

Our terms and conditions are stated on the very first page, you have to click on them before signing up. Moreover the terms and conditions are not endless and written in black bold letters.
Agreeing to terms and conditions is legally parallel to signing a contract (as we have all the proofs needed) - for example if you sign a contract to get a house on the [redacted] but pay for it on the [redacted], then it’s legitimate because both sides agreed to the terms, if you didn’t read the contract and signed for it with the impression the house will be for free, then it’s clear that the seller won’t return the money when you figure it wasn’t.
Our trial offer is more than fair; it gives you the opportunity to try the products and if you don’t like it you can return return it as long as that you are still within the trial period. You had the opportunity to get a free amount of the product, within the trial period,but you did not contact us before the end of the trial period, according to the terms that you agreed by signing up, we charged you for the amount stated on the terms and conditions.

I have no recollection of any such box to un-check.  Nor do I recollect any terms and conditions.  I received no receipt of any kind, no communication in my e-mail and NO ORDER CONFIRMATION.  When the trial bottle arrived there was no paperwork enclosed.  Nowhere did I have terms and conditions that were obvious.  I tried to call the numbers provided on my credit card statement by your company right away and they were non functioning.  Furthermore, I did not even receive any order beyond the bottle of Green Garcinia which I agreed to try and the Ven Cleanse which I did not want.  
I believe that there should have been an order confirmation to my e-mail with the terms outlined so that I could have cancelled in a timely manner.  Again, I did not see or receive the terms that allegedly appeared on your web page.
I respectfully ask that I be refunded the entire amount of the charges for Green Garcinia and Ven Cleanse (79.95 plus 89.99) respectively the amount knowingly I agreed to.  If any product arrives I would be willing to return it with a shipping label provided by the company.

I will accept the offer of $50 refund as stated in the letter they sent to you, the Revdex.com.  I have cancelled the card that they were issuing charges on to ensure no additional charges are made.  I would also like to insure that any reoccurring shipments, billing or agreements with this company are stopped.  Thank you for your assistance in this matter.  I do feel the way this company has handled its business is not open and forthright.  A reputable company would not hide charges in a box that is not easily viewable and offer a 14 day trail that ends 9 days after you receive the product but 14 days from the order.  Additionally, reviewing the internet shows that there are numerous consumers who have had the same concerns and issues with this company.  Unfortunately, the company appears to have managed to find a legal way to continue take advantage of consumers.  It is my hope that this letter is forwarded to the company and the response is given through the Revdex.com so that I have documented proof of correspondence.  Already, the company and I have not agreed on if I ordered the second product, which I still state I did not.  Hopefully, correspondence through the Revdex.com will make the outcome a clear and open communication.

We are a fair and legitimate company, all our promises are stated at the terms and conditions, and all the promises our company made are always fulfilled - there is a trial period, as stated in the Terms and Conditions and there is a specific period where you can only try the products for free. The word "sample" was never mentioned in our terms and the word "free" was related to the trial not the product.
Our trial offer is a way of the company to verify the customer's satisfaction, it means our company is so confident about our products that it would let our customers use it at the company's expense to assure them that they are dealing with a high quality products.
The fact that our customers decided to get advantage of our company's offer and get "free stuff" at our company's expense isn't it legitimate? As the trial was created for our customers who are trying to decide if our products are good for them and not for people who want to take advantage of a fair trade.
As we have stated the customer was charged on 08/**/2014 12:13am to be exact for $89.97 and we ask the customer to provide the proof that she was charged on 7/** because the date of charge should reflect on customer's Bank statement and it is not possible for the customer to be charged within the trial period. If the customer was charged within the trial period, why her Bank did not decide on her favor? Because we did charge the customer after the said trial period which is stated on our Terms and Conditions.

Following up my phone conversation yesterday, this complaint should not be closed.  I am providing two additional pieces of information which are relevant to my complaint.
1.  In spite of the claims that I "subscribed" to a program to have my bank account looted monthly in exchange for a bottle of 60 capsules of dubious value, I did not.  Furthermore, when I spoke to the people at Green Garcinia about getting a refund, they said they could not refund the money, but they would cancel my subscription and send no further merchandise.  They have not sent any further shipments, but they also have not refunded the $89.97 deducted from my bank account on September * for which they have not sent any shipment.  At minimum, I want the money back at least for a shipment they did not send.
 
2.  It seems a suspicious coincidence to me that during this whole time frame, Microsoft tech support tells me that my computer was hacked and a vicious KoobFace "worm" installed that allowed others to access my personal information.  I wonder how that could have happened.  The problem has been resolved, but I wonder if that explains how someone could go into my system and establish an account for me.

Since cancellation applies only to future orders that have not already been shipped or delivered, there is no need to return anything. Review: I answered a short "survey" on-line that said COX. I was told that in exchange for the survey information I would receive a "free" gift. All I had to do was pay $4.95 shipping and handling charge. I selected the Green Garcinia for the free gift. As soon as I entered the product and my VISA card number, I was disconnected from their site. I was not sure the info had even gone through until I saw that the $4.95 had been deducted from my account, and shortly thereafter I received a bottle of 60 of the supplements. When I discovered that $89.97 had been deducted from my account on 8/**, I contacted my bank. Around 9/*, another $89.97 was deducted from my account, although the bank manager had flagged the account when I reported an unauthorized deduction. She had told me I had to first attempt to resolve the issue with the company. The only information there we had about the deduction from my account was that it was paid to "[redacted]." I tried calling the number many times over the next several days, day and night, and only ever got a busy signal. I waited to see if any kind of a product was ever shipped so I could get some kind of contact information or address or company name. After the second deduction from my account, I received a package containing another bottle of 60 capsules, from which I obtained the business information above. On 9/** I called the customer service number and spoke to a rep who told my that since I had signed up for a "trial subscription" on July **, it was past the thirty days that they could make an adjustment. I told her I had never signed up for any purchase nor authorized any deductions from my account. I could not understand her name as she had a heavy accent of some kind and the noise in the background was nearly drowning out everything she was saying. I told her I wanted all of the money back in my account. She was not authorized to do so, but she would give me $10 out of her own money.Desired Settlement: The rep called me back to say she had "escalated" my request and had received authorization to refund me $50. I told her that was not good enough, and unless she could get authorization for a full refund not to bother me again. I want both payments that were illegally deducted from my account refunded to me in full.

The customer called us yesterday, September ** to cancel her subscription but he was charged already for two $89.97 which is for the full cost of the Green Garcinia because the 14 day trial that was given to the said product has already ended and the other $89.97 was for the 2nd bottle of Green Garcinia that was shipped to her. To clarify, she was charged already before she even cancelled her subscription. That's why when the customer contacted us yesterday, via phone to cancel the subscription, one of our Customer Service Representative explained why the customer was charged for the said amount and was told that she's no longer eligible to get a full refund since our 30 days money-back guarantee period for her account has already expired because it's been 2 months already and the money back guarantee applies only to the initial bottle and all bottles that was shipped to the customer after the initial order are considered final sales - that is clearly stated on our terms of service.

However, we have every desire to address the customer needs and provide the best solution available to resolve the issue, that's why our Customer Service Representative escalated the customer's concern and we did make an exception to settle the customer's issue. With this, we can apply a discount coupon in the customer's account to provide at least a $50.00 courtesy refund for the latest charge of $89.97 or we can also send another bottle of Green Garcinia for FREE (including the shipping) as a complimentary to resolve the customer's concern. Please let us know which of the two given resolution the customer would prefer.

Following up my phone conversation yesterday, this complaint should not be closed. I am providing two additional pieces of information which are relevant to my complaint.

1. In spite of the claims that I "subscribed" to a program to have my bank account looted monthly in exchange for a bottle of 60 capsules of dubious value, I did not. Furthermore, when I spoke to the people at Green Garcinia about getting a refund, they said they could not refund the money, but they would cancel my subscription and send no further merchandise. They have not sent any further shipments, but they also have not refunded the $89.97 deducted from my bank account on September * for which they have not sent any shipment. At minimum, I want the money back at least for a shipment they did not send.

2. It seems a suspicious coincidence to me that during this whole time frame, Microsoft tech support tells me that my computer was hacked and a vicious KoobFace "worm" installed that allowed others to access my personal information. I wonder how that could have happened. The problem has been resolved, but I wonder if that explains how someone could go into my system and establish an account for me.

Thank you for your response. To answer the customer's claim "To recap, I paid for a "free gift," and two additional bottles, a total of three. I have only received a total of two, so I feel I am owed a refund for the third one that was not shipped". - Below are the information that explains why customer received only two bottles when according to her she paid for three.

07/**/2014 - The date where the customer paid for $4.95 Shipping and Handling fee of the Green Garcinia initial bottle.

08/**/2014 - Customer was charged $89.97 which is for the full cost of the Green Garcinia inital bottle since the 14 days trial has already ended, to clarify this is only a charge for the initial bottle that she received and not for another bottle.

09/**/2014 - Customer was charged another $89.97 for the second bottle of Green Garcinia that was shipped and delivered to her since what she have avail is a trial offer that turns into a monthly subscription after the 14 days trial.

Basically, the customer is only supposed to receive two bottles of Green Garcinia and based on our records both bottles has been shipped and delivered already.

Since the customer agreed to the $50.00 courtesy refund as a resolution to her concern, we already processed the said refund back to the customer's credit card. Please allow 3-5 business days for the said refund to reflect in the customer's account. We already cancelled her subscription for her to avoid any further charges. Rest assured that no more future charges will be taken out & no more products will be sent out to the customer.

They told her she had to read the information in the package that was sent. There was no information in the package sent. Review: I had ordered two trial size bottles of their product and paid $4.95 for each bottle with my Visa debit card. Two weeks later, they charged my Visa debit card $89.97. To clarify what we are offering is only a free trial and not a free samples. Our trial offer is a way to get the full 30 day supply of Green Garcinia and Vencleanse where the customer will pay only $4.95 upfront and enroll in our monthly subscription. After the 14 day for the Green Garcinia and 16 day trial for the Vencleanse expires, the customer will be charged $89.97 for the Green Garcinia and $79.95 for the Vencleanse which is the full cost of the bottles. A trial is not a free sample.
