I hired a landscaping company to remove tree roots from my back yard, and then create a concrete patio around my deck. Job was not completed.
On May 28, 2020 I signed a contract for Green Thumb Landscaping LLC for the removal of tree roots in my back yard, and to create a concrete patio to the whole back yard around my deck. On that same day, I made a down payment of $1500 for the project. Work was to begin on Friday, May 29th. However, the landscaper did not appear until the evening of May 30th. On May 30th, the owner of the company, and her assistant started work on the removal of the tree roots. The landscaper attempted to remove the roots with an ax and a saw. They quickly realized they were not going to be able to remove the roots that way. They said they would come the next day with a stump grinder to grind the roots. The two returned on the evening again, of May 31st to resume work. After working for a few hours, they told me removing the roots were more difficult than they initially thought. The owner said they will not be able to remove the roots, but should be able to grind the roots enough so that the concrete can be poured. The owner told me they would return the next day, with the grinder to finish that part of the job. At that time, they requested the second payment of $1300. I paid the owner as required by the contract.
The landscaper texted me on June 1st stating they were held up on another job, and wanted to know if they could wait until June 2nd to come to my home to resume grinding of the roots, and to discuss a new job completion timeline. I texted them back stating tomorrow will be ok. However, the two did not show, or call on June 2nd. On June 3rd I receive a text from the landscaper asking if he could call me around noon,. I agreed to the call. Noon came and went, but I did not hear from the landscaper. At 9:11 pm that night I get a text from the worker saying, "we have 2 options we can continue to try with the saw(we were being charged by the hours with the grinder) and we can see how much we can do and I can also spray and bring some root killer to dry them up or
the other option is to put layers of topsoil until its even and then do the concrete. they won't grow thru the concrete. ...those are the two best options."
So on June 5th, 2020 I sent a certified letter to the company requesting termination of the contract because I felt the company had repeatedly failed to render the services for which I had paid. I felt they had breached the contract.
I sent the letter to the business address listed on the contract, and also to another address that I had located online for the business. The USPS was not able to deliver to the business address that was listed on my contract. However, they were able to deliver the other copy of the letter to the other address I had located.
On June 11th, I received a text from the landscaper asking what I wanted to do moving forward. As stated in the letter that I sent, I told them I would like a refund of my $2800 minus the cost of the rental of the stump grinder. They responded that refund of my money 'was not an option.' The best they said they could do was come up with another plan to remove the roots.
That was the last that I heard from landscaper.
I am seeking a refund of the $2800 that I paid to the company, minus their cost of the rental of the stump grinder.
