Merchant misrepresented his products capabilities. After being asked several times if the golf cart would pull hills in our subdivision and the sales rep confirming that they would we put down a deposit on the golf cart . A friend that bought the same cart that day had to return hers that lives in our subdivision . They had to upgrade to a bigger more expensive cart that I cannot afford to do . The sales rep told us it would pull our hills and if it did not we would work something out with our deposit. He stopped answering our calls once we told him we wanted a refund . We have disputed the charges with our credit card company and a refund is pending . I never took possession of the golf cart . The dealer has had it this entire time . He has not lost anything . He has had the cart there is no use from us on the cart because we never took it with us . It is our deposit we would like back since the cart doe not perform as promised .
The customer did in fact come purchase a cart from me and put a $500 deposit down and requested that he have six to eight weeks to pay the balance as she did not have the money. ( I sold this to a woman not a ***). she was riding along with her friend who had purchased one from me and was there to pick it up. Several days after she called me with concern about the power of the cart that her friend had as her friend was having trouble climbing a large Hill in their subdivision. I reinstated the need for the break in process that is required for those engines to have full power they will only have half power until about a hundred fifty miles. I had no trouble giving refund if the cart would not perform as needed but I did request at least let it get to the breaking point. Her friend decided they would just go ahead and upgrade to the much larger version intern I drove to Atlanta to pick up the larger version brought it back for them and work they deal to make them happy. The lavere's contacted me with still concerns that when they got theirs it may not do what's needed and I reassured them that as long as they followed the break-in. It would do so if not I would refund it completely. That was July 2nd 2018 they asked me to send them a copy of the break in process so I did. I have not heard from them since and it's now coming up on the 6 to 8 week time frame for them to pick up and I assume they have determined they do not have the money to pay the balance or are having buyers remorse, so they contacted you directly to help get the refund. They have never directly asked me for a refund. Again I have not heard from them since July 2nd 2018. I have attached our Communications via text from the last time I spoke with them on July 2nd to the messages from today after I received your letter. I have issued them a refund on their credit card which I have also attached a copy of the email for that. Since this refund I have found out from the friends that the husband was mad at wife for doing the deposit and they were having buyers remorse about purchase. And wife was telling husband that she tried to contact me to passify him hoping he would let it go so she could get the cart. But he filed complaints and then I finally get contacted by attorney general about his complaint. I immediately issued the refund as I did tell him I would. I was NEVER asked for a refund. I was only asked if cart did not perfory would I refund and I said yes. The customer never finished paying to pick it up to try it. I held on to this cart for 8 weeks waiting for them to come up with rest of money. I could have sold it many times while waiting but I kept waiting for them. I did refund and as far as I can tell the husband is fine now. Just to be clear. I HAVE NEVER DEALT OR TALKED TO THIS MR Laviere. Only the wife when she was here to pay deposit and once when she text about break-in process. Attached text communications.
