circumstances. Upon reconciling membership records in December of 2016, we found that [redacted] stopped paying her monthly membership dues and she owed a past balance for October, November and December. We attempted to collect that balance and were not able to fully do so. At that point we received a phone call from her and tried explaining why we were attempting to collect past dues. [redacted] claimed that she had cancelled her membership. We asked her to provide a cancellation receipt (as is customary for all our members) and she did not do so. We informed [redacted] that we did not have any documentation that she requested her membership be cancelled and also told her that we would cancel the membership, however, all past due balances would have to be paid in full. On January **, 2017, we received a phone call from [redacted]'s attorney, [redacted]. We reiterated the same information to him as well. We also provided [redacted] with a copy of the membership agreement which confirms that if a member desires to cancel their membership, the member is to send in 45 days prior to the billing date ([redacted] of each month) written notice of desire to cancel the membership in order to be effective. We would be happy to provide you with the same documentation at your request. We did not receive the cancellation notice from [redacted] until January **, 2017. Please be advised that gravity fitness management has not harassed [redacted] or her family in any manner. We only spoke with her and her husband once at our initiation and another time while answering her husband's phone call. All other communication transpired between us and the attorney representing her while we explained to him the details of our membership agreement and provided proof of such agreement. To date, the unpaid amounts due under the membership agreement are outstanding and unpaid.
