I leased a vehicle from this company December 31,2019 and I had to return the vehicle on January 8,2020 due to it catching fire. I was driving on the road and oil start leaking onto the spark plugs which caught the car on fire. The vehicle was towed to the company, in which they were suppose to fix the car and I was suppose to be notified when I could pick up the vehicle. I never received a call. I called on several occasions, in which the manger was very rude and disrespectful and wouldn't provide me no updated information regarding my vehicle. I then went to the establishment on January 31, 2020 to speak to the manager and to see if I could pick up my vehicle. She refused to release my vehicle,because she said I hadn't made a payment, which I only had the car for a week and a day not long enough to make a first payment. She wouldn't refund me the money I gave them for a down payment. I was not offered a replacement vehicle neither. She threaten to call the police on for asking questions regarding my vehicle. After refusing to give me the vehicle she stated that I still owed them *** dollars.
Refund I would like to be refunded the *** dollar that was given to the company for a down payment on the vehicle of choice.
Mr *** purchased a 2011 Chevy Cruze from us around December 2019. About 2 weeks later, he called stating that the dash kept beeping telling him that the engine was hot and he needed to pull over and shut if off. He said that for 3 days he did this and then the final time was when it started smoking and shut down on its own. He popped the hood and found oil everywhere. Grand Theft Autos payed for a tow for him back to our company when he expressed that he could not afford it. Once there, we evaluated the vehicle and found no evidence of fire at all. The oil was hitting the motor that was extremely hot due to a part that had been previously replaced malfunctioning causing smoke. Mr *** signed in 3 places that he understood all parts and labor are at his expense because the dealer offered no warranty and he waived the additional warranty that was offered to him. However, we did choose to help him anyway. We purchased and paid for his tow, the parts and labor. Mr *** was called and told that his vehicle was ready for pickup about two weeks later due to the part being delayed in shipping. He began having his family call and message us stating that they were going to sue us. The owner reminded him that he did not have a warranty and everything we had done we did in kindness and legally we were required to do nothing. He calmed down, and he apologized so we did go ahead and fix the vehicle. HE called me stating that the vehicle would have to be there until the following month due to not having money to pay the payment as well as the sales tax. I told him per his contract he signed he did need to at least pay the deferred amount and I would waive his first payment. He said he would be in on Friday to pickup the vehicle and make his payment. He showed up on Thursday to get the car, when I asked about his payment and told him he could make it Friday I just wanted to verify that he was still planning to make it due to previous conversations I was unsure where he stood. He became very irate and told me that he shouldn't have to make his payment because he didn't have the car. I asked him to step outside so that I could call the owner and see what he wanted to do. The owner stated that due to us already being out money for fixing the vehicle and towing the vehicle on an as is/no warranty sale and because he waived the warranty that would have covered these expenses he would need to make at least the amount he deferred. The vehicle he purchased was *** down and he only payed *** down so we deferred *** of his payment to help him get the vehicle he wanted. He test drove the vehicle after my almost forcing him too because he saw it and knew that was the one he wanted. After he became so furious I did tell him that he would need to leave unless he could pay the payment or I would have to call the police to get him off the property. His mother called 20 minutes later and got the whole story and agreed 100% with our company and stated that he should have just done what he was supposed to do and that she understood where we were coming from. That we had tried our best to help her son and this would be lesson learned. She asked me to contact the owner and see if we could deal with her for the remainder of the load, I did, the owner stated that since he wanted to threaten to sue us and since we had tried so hard and nothing seemed to help Mr *** that he felt like the situation had already been taken too far and he would need the full payoff of the car for us to give it back to him.
