the sale prior to receiving a bidding number. Dennis [redacted] registered online and accepted the terms of sale: "After the Auction CO has sold a piece of equipment, it becomes the sole responsibility of the purchaser. All equipment is sold as is and where is." "All property is sold "AS IS," and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Grafe Auction CO may attempt to describe the merchandise in advertising, on the internet and at the auction but makes no representations. In no event shall Grafe Auction CO. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value." Mr. [redacted] emailed our office on 05/01/17 stating there might have been a power surge after the auction and he felt he was entitled to a refund. We responded to Mr. [redacted] in an email outlining the company's terms. Although Mr [redacted] has filed a complaint against our company, he continues to participate in our online auctions.
