Complaint: [redacted] I am rejecting this response and attached is my Written Rebuttal for details I am also attaching the [redacted] Tool Box Prices that would be equivalent to the tool box damaged by Gerber Towing mentioned in the Written Rebuttal I look forward to a response toward resolving this matter very soon Thanks This is in response to the communication recently sent from MrGary G***, in his E-mail, he contends that he has been trying to get in touch with me numerous times This incident occurred on 9/4/and I had a difficult time reaching Mr [redacted] and left numerous phone messages at Gerber Towing in an effort to resolve the matter Soon after the tool box was damaged, I could not get in touch with Mr [redacted] , only to find sometime later he had gone on vacation and after I finally got in touch with him he stated “ to be honest, I forgot about it”.He also states in the E-mail that my tool box had been damaged previously due to a vehicle hitting it, I assure you that the box was never damaged in any manner and I never said such a thing to Mr [redacted] Also, Mr[redacted] has stated that he has viewed numerous tool boxes and in addition conveyed this information to me, but he only sent me one option which is the 10/23/email he referenced, which I did in fact go to check out that day October 23rd The unit was at Harbor Freight, while viewing the tool box I was told by the salesperson that this was not the box I needed for my type of work as an automotive/diesel mechanic, as it was described as being too light duty I called and left a message at Gerber Towing that the tool box he recommended would not meet my needs as a replacement He called back on 11/2/and left a message to contact Mr [redacted] .Mr [redacted] claims in his E-mail that he told me that he would have to refer it to his insurance company if the tool box was $is not true What he said was “I don’t know what to do and will discuss it with my wife” He never called me back and never offered the name of his insurance company.I called Mr [redacted] with the law office working for Mr [redacted] The gentleman told me that I should not expect to get full price for my loss due to the age of the tool box, I explained that the tool box Gerber Towing damaged had a life-time-warranty; however, the box has been discontinued I proceeded to contact the tool department at Sears and requested the updated price if the tool box were still available The full price for the box if it were still available would be $according to Sears I informed Mr [redacted] of that amount and he asked me to send him copies of the Sears information.I have truly tried to resolve this matter in a timely fashion and I have lost out on at least five jobs waiting for a fair resolution Every time I remind Mr [redacted] that I cannot work if I don’ have a way to transport and store my tools it seems to make no difference Because I cannot afford to be without a paying job, I borrowed some money from a friend to make a down-payment on the tool box that I need for work, the tool box that I had informed Mr [redacted] about back on 9/7/ I would like the matter resolved and be reimbursed a fair amount for the tool box that Gerber damaged.Best Regards, [redacted] Sincerely, [redacted]

Gerber Towing has been in contact with the customer and we have been trying to come up with a comparable size and quality of tool boxes to meet his needs for replacementThe customer originally wanted us to replace his box with a box that was $6000+ and we did not feel that was a reasonable situation since his original boxes were worth less then $We have been going back and forth discussing options to get him something that would be a fair dealI understand that we were at fault for the situation that happened and have been more then willing to work with the customer to get him a new boxI feel strongly that he is asking for much more then what was damagedI have looked around at many places including ***, [redacted] , [redacted] ***, and [redacted] to find him something that will be comparable to what he hasHe also informed me that the toolboxes were purchase years ago and were ran into by a car at one of the places he previously workedThese situations would bring down the value of what was damagedMy primary goal is to get him a good quality new tool box that is size comparable but I cannot see how it would be fair to buy a top of the line box for $when it was years old and had previous damage and he paid less for his original boxI have found a few options of tool boxes to offer himOne that I felt like was a very good option for him, we looked into where it was manufactured and have done a lot of research on thisI have also brought up numerous times that if we had to go the route of the box that he wanted for $then we would need to turn into our insurance companyBelow I will include an email I sent to him regarding one of the options we were able to offer himI have since gave him contact information for our insurance broker to contact him and see what route he would like to goWe never want to have dissatisfied customers and are trying to work with the customer to make a fair deal, if it needs to go through insurance we have given him that option *** and our company are not able to agree on a fair deal of replacing his tool box, so he has been advised to deal with our insurance to be reimbursed or have the tool box replacedWe did not mean to extend this out as long as it was but I thought we would be able to get *** a comparable box with what we felt was fairI did not feel like what he was asking for was fair and I feel like he was trying to get top of the line equipmentWith what he is wanting and expecting and since we were not able to agree on what we thought was fair compared to what he thought was fair he was advised to go through our insurance (*** ***), I met with *** on Friday and he states he will be getting back to *** on MondayWe are very sorry for how this turned out and how long it took to get this figured outHopefully going through insurance can make the customer satisfied and feel like he got a tool box that is to his standards and meets his needs

I have also brought up numerous times that if we had to go the route of the box that he wanted for $6000 then we would need to turn into our insurance company. Below I will include an email I sent to him regarding one of the options we were able to offer him.
