Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below First and foremost, I would like to make it clear that I am NOT trying to get ANY free repairs for this car but instead to bring to light things that I was promised that were not honored by Genesis AutomotiveMr[redacted] and his associate “***”, who never gave us his real name nor did he want to when we asked, told us: “ Don’t even worry about any repairs, you can come into the shop and get it done without spending out of pocket and we will just add it to the end of your loan” Well I tried to get this so-called “deal” and was instead met with either “call me in a couple of days and we will take a look and see what needs to be done” and then I would call back and no one would answer or even call back OR no one would answer at all and Mr[redacted] would be out of the officeI was told and promised by “***” that “the car has gone through all the necessary repairs from top to bottom, left to right, tires & shocks are BRAND NEW and there is nothing to worry about, the car is like new and the air conditioning is awesome.” So with that my wife and I signed the agreement thinking that we had a car that was in tip top shape and that there was nothing to worry about and that we had a little peace of mind when we were promised the deal as described aboveAs far as speeding, I cannot and would not bring this car anywhere past MPH as it would shake violently and would almost lose control as it hit cracks in the asphaltI am not a mechanic nor is my wife and we took the word of a “mechanic” that the car was good and we took the word of a “car dealer” that if anything was in need of repair we could get the work done and they would add it to the end of our loan with no out of pocketOn May 2, 2014, Mr [redacted] had contacted me via text and told me “ [redacted] you need to call back [redacted] and stop complaining about repairsThey will not buy the loan if your b***ing about the carTell them you are getting it fixed and it’s no big deal so they will buy the loanThat is the only way your payment will be moved to the 17th.” And then quickly followed it up by saying: “Tell them you made an appointment to have it all repaired alreadyThey are afraid you will stop paying cause it needs repairs.” This is my only mode of transportation and from what he says was the ONLY way to get my payments moved so I did what I was instructed to do thinking that he was going to do the work and fulfill the “deal” but I never heard from him after thatWhich brings me to the payments of the car, I have not been late for payments as he instructed me that given my financial situation I could pay on the 17th and everything would be fineMy wife was pregnant at the time of purchase and her hours at work were cut to part-time hours and then she resigned from her job so that she could comfortably finish the pregnancy and be a stay at home mother till the baby was old enough for day careI let Mr [redacted] know of the situation and asked to have the date moved I did NOT beg at any timeHe stated that “the ONLY way to get that done is to re-sign new paperwork and it was a bit of a hassle to do that” and “ to just pay on the 17th or before of every month and I would be golden” that was the end of the conversationI Have done all the things that he has instructed me to do and with nothing to show for to date, I understand the “AS-IS” policy of a dealership but in understanding that it is the dealerships job to divulge any information of repairs that will be needed on the car being purchased that would make the car potentially unsafe to drive especially with an infantWe were told that the car was in great shape and virtually EVERYTHING was brand new or repaired and it was certainly not the case and the “deal” that was promised was not honored at allAs of June 05, I had purchased at [redacted] the shocks ($each) and struts($each) for all wheels and I also rented a special spring clamp ($50.00) so that I could replace them; then on June 14, I replaced the shocks and struts and replaced all four tires ($230.00) which came out of my pocketI am not here to get any hand me outs or freebies because I know that when it comes to a cars, things are expensive and sometimes very labor intensive but when a promise is made but not honored it makes you think of how many other people have been told this same “deal” and how many other vehicles are out there from this shop that have “NEW” or “REPAIRED” items that really don’tI am a father and a husband and I don’t think it to be fair that I am considered in the wrong and that “I should have come to the shop when these problems started” when all points of contacts were made with no answer, the “deal” not honored and I am driving with my family in an unsafe vehicle that was said to be “repaired and virtually brand new.” If I need to pull my payment records to prove our payments have not been late "every" monthI also can have a statement from the auto body employee who worked on my car about the shape my vehicle was inI want it to be known that had he been up front with the damage I would have gone with another vehicle or another dealer all togetherI have had my wife and child in the car when it begins to shake and when I would hit a small pot hole or go over a bump the vehicle had no control
to Revdex.com, Let me start by saying that this is the first I have heard about this customers complaint. Every car sold in AZ from a dealer ship must give a warranty of 15 days or 500 miles which ever comes first. This warranty does not include maintenance items such as Brakes, Struts, or tires....
The [redacted]s bought a used car and signed a contract stating the dealer implied warranty and after that the car is sold AS IS. I offer to all my customers if any repair work is needed that I will beat any other repair shops price to help them out with the costly repairs. This was offered to [redacted] but I was told that it should of been part of the deal. At Genesis we carry loans in house and we also sell loans off as we feel necessary. This is clearly written in the sales contract and was signed by [redacted] agreeing that we may sell his loan at anytime. As a company that deals with bad credit customers we install a GPS device in the vehicles which monitors not only where the vehicle is but there driving habits as well. I have recorded speeds in [redacted]s vehicle of over 100mph. That's very fast for a car that is not safe for the road and driving at speeds like that it can cause excessive wear on suspension parts and especially brakes. Now for the part about me lying to sell a loan. [redacted] has been late on ever payment. When the loan was initially sold to [redacted] very first payment was late and went into default resulting in Genesis Automotive buy the loan back. every payment since then was late almost resulting in a repossession. [redacted] begged to have his payment moved to the 17th and I informed him that until he was current on his payments the date would not change unless I sold the contract with the stipulation that the payment be moved. so the loan was sold again to [redacted] in an attempt to help [redacted] on his late payments. This is clearly an attempt to get free repairs done to the [redacted]'s vehicle and am sure the miles that have been put on since the purchase of the vehicle have been pretty hard. If they would like to see my GPS records of them speeding on freeways quite frequently they are more than welcome to. I will still offer my service to them and I will beat any other ASE certified shops quote to help save them money on any repairs that they may need. please feel free to contact me further on this matter as I am fully willing to make sure all our customers are happy. Thank you for your time. [redacted] (owner)

I have reviewed the response made by the business in reference to complaint ID[redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. First and foremost, I would like to make it clear that I am NOT trying to get ANY free repairs for this car but instead to bring to light things that I was promised that were not honored by Genesis Automotive. Mr.[redacted] and his associate “[redacted]”, who never gave us his real name nor did he want to when we asked, told us: “ Don’t even worry about any repairs, you can come into the shop and get it done without spending out of pocket and we will just add it to the end of your loan”. Well I tried to get this so-called “deal” and was instead met with either “call me in a couple of days and we will take a look and see what needs to be done” and then I would call back and no one would answer or even call back OR no one would answer at all and Mr.[redacted] would be out of the office. I was told and promised by “[redacted]” that “the car has gone through all the necessary repairs from top to bottom, left to right, tires & shocks are BRAND NEW and there is nothing to worry about, the car is like new and the air conditioning is awesome.” So with that my wife and I signed the agreement thinking that we had a car that was in tip top shape and that there was nothing to worry about and that we had a little peace of mind when we were promised the deal as described above. As far as speeding, I cannot and would not bring this car anywhere past 70 MPH as it would shake violently and would almost lose control as it hit cracks in the asphalt. I am not a mechanic nor is my wife and we took the word of a “mechanic” that the car was good and we took the word of a “car dealer” that if anything was in need of repair we could get the work done and they would add it to the end of our loan with no out of pocket. On May 2, 2014, Mr. [redacted] had contacted me via text and told me “[redacted] you need to call back [redacted] and stop complaining about repairs. They will not buy the loan if your b[redacted]ing about the car. Tell them you are getting it fixed and it’s no big deal so they will buy the loan. That is the only way your payment will be moved to the 17th.” And then quickly followed it up by saying: “Tell them you made an appointment to have it all repaired already. They are afraid you will stop paying cause it needs repairs.” This is my only mode of transportation and from what he says was the ONLY way to get my payments moved so I did what I was instructed to do thinking that he was going to do the work and fulfill the “deal” but I never heard from him after that. Which brings me to the payments of the car, I have not been late for payments as he instructed me that given my financial situation I could pay on the 17th and everything would be fine. My wife was pregnant at the time of purchase and her hours at work were cut to part-time hours and then she resigned from her job so that she could comfortably finish the pregnancy and be a stay at home mother till the baby was old enough for day care. I let Mr. [redacted] know of the situation and asked to have the date moved I did NOT beg at any time. He stated that “the ONLY way to get that done is to re-sign new paperwork and it was a bit of a hassle to do that” and “ to just pay on the 17th or before of every month and I would be golden” that was the end of the conversation. I Have done all the things that he has instructed me to do and with nothing to show for to date, I understand the “AS-IS” policy of a dealership but in understanding that it is the dealerships job to divulge any information of repairs that will be needed on the car being purchased that would make the car potentially unsafe to drive especially with an infant. We were told that the car was in great shape and virtually EVERYTHING was brand new or repaired and it was certainly not the case and the “deal” that was promised was not honored at all. As of June 05, 2014 I had purchased at [redacted] the shocks ($35.99 each) and struts($119.99 each) for all 4 wheels and I also rented a special spring clamp ($50.00) so that I could replace them; then on June 14, 2014 I replaced the shocks and struts and replaced all four tires ($230.00) which came out of my pocket. I am not here to get any hand me outs or freebies because I know that when it comes to a cars, things are expensive and sometimes very labor intensive but when a promise is made but not honored it makes you think of how many other people have been told this same “deal” and how many other vehicles are out there from this shop that have “NEW” or “REPAIRED” items that really don’t. I am a father and a husband and I don’t think it to be fair that I am considered in the wrong and that “I should have come to the shop when these problems started” when all points of contacts were made with no answer, the “deal” not honored and I am driving with my family in an unsafe vehicle that was said to be “repaired and virtually brand new.” If I need to pull my payment records to prove our payments have not been late "every" month. I also can have a statement from the auto body employee who worked on my car about the shape my vehicle was in. I want it to be known that had he been up front with the damage I would have gone with another vehicle or another dealer all together. I have had my wife and child in the car when it begins to shake and when I would hit a small pot hole or go over a bump the vehicle had no control.
