Review: Generation I and [redacted] entered into an Independent Contractor Agreement ("ICA") on August *, 2014 with an agreed to completion date of November **, 2014. Soon after the ICA was executed, delays began, and work did not start in earnest until October 2014. Generation I took actions inconsistent with the ICA and inconsistent with industry standards, including but not limited to: failure to obtain proper permits in a timely manner; improperly filed permits; incorrectly executed approved plans relating to stairwell clearance dimensions; utilizing an unqualified structural engineer, who had to be replaced; providing the new structural engineer with incorrect plans; failure to properly manage subcontractors or oversee work at property despite having told [redacted] they would be on site; providing incorrect and often changing advice regarding Terrazzo flooring; failure to properly cover and protect bathrooms, floors, hallways, and common areas, which resulted in property damage; continuously delayed provision of structural designs and project timelines despite repeated promises to provide to [redacted]; failure to have sufficient number of workers on site to move project along; billing for work that was not actually completed; charging for materials that cannot be located and, upon information and belief, were never purchased; incurring code violations which were not corrected in a timely manner; submitting change orders after expenses were incurred without permission; incorrectly cutting a slab for staircase, causing property damage and requiring new plans; incorrectly fabricating stairs to incorrect size; incorrectly and falsely advising [redacted] certain work was completed when it had not been; failing to timely pay subcontractors working on Generation I's behalf, resulting in work stoppages, delays, and poor morale; and other damages and failures for which [redacted] is paying to repair, correct, or complete.Desired Settlement: Miracle NY Properties has incurred significant sums, and will in the near future incur additional damages as a result of Generation I's actions. [redacted] seeks a refund of all monies paid to Generation I under the ICA, reimbursement for additional damages, and reimbursement for legal fees and costs.
