The customer told me that her car was damaged with 5 payments left on the lease. She was expecting a check from the insurance company ( [redacted] ) the policy that was shared by her and her father. She wanted the Kia Sportage which is bigger than her current car and she knew it would...
cost more than her current car and she was prepared to put additional monies down to get a comfortable monthly payment. I advised her that we could not trade in a car and wait for an insurance check that may or may not come, since she has 5 months left and available money to put down on a new Kia she decided to take the current car out of the equation, use the insurance check to pay for the damages since that is what insurance is for, and we discounted the new Kia further so that her monthly payment would be comfortable for her with less money down leaving her enough to pay her remaining 5 payments. Her father told me that his insurance company gave him a check for the damages and now the complaint says that the other party sent a check for the damages.
Review: I leased a 2012 Kia Soul from Towne Kia and was in an accident that was not my fault. I received a check from the other driver's insurance company to repair the vehicle. Gateway Kia contacted me before I had the Soul fixed to come in and end my lease early to get into a new vehicle. My lease would have been up in March, but the Soul was horrible in the snow so I decided to take a look at what my options would be through Gateway Kia. Upon several discussions with my sales rep [redacted] and [redacted] it was decided that they would take back my Kia Soul as is with the damage after I paid out the remainder of lease ($1,200). I then would lease a 2015 Kia Sportage and use the insurance money for the Soul towards the down payment on the Sportage. I was instructed to take both cars home with me until the final payment of $1,200 cleared through Kia financial and then I was to drop off the Soul. Upon dropping off the Soul Kia changed their verbal agreement with me claiming that they never said they would take the Soul back with the damage and that I would be responsible for any damages that Kia Corporate finds on the car! I did not get anything in writing as it was a verbal agreement. They are refusing to follow through with our original agreement and now I have signed legal documents that will not let me out of current Sportage lease. Had I know this would be the case I would have done what any logical person would have and had the Soul fixed with the insurance money and kept it through March to trade in for the Sportage. Now I am responsible for covering the damage from a no fault accident out of pocket. Coincidentally, one of the sales reps who made this deal (Mr. [redacted]) is no longer with the company and Mr. [redacted] is on a two week leave. This kind of bait and switch mentality is unacceptable and they clearly used manipulative sales tactics to get me to sign a deal in their favor leaving me to suffer the consequences.Desired Settlement: I would like Kia to follow through with their original agreement and take back my Soul with the damage free of charge.
