Subject: *** Complaint Case ***
Ms.,
Mr. came to our office to take a licensing examination. Upon arrival it was explained verbally, and in writing, that NO NOTES, MARKS, DOTS, or NOTATIONS shall be made in the approved reference materials being used during the examination and/or review. Mr. read, and signed a notice stating this. At that time he also stated that he had a learning problem. He was asked for documentation of the problem as is stated in the American's with Disabilities Act and is standard practice in the industry. He stated that he would provide it in the future.
After he had tested and then reviewed his failed examination he decided to test again. Upon review of his testing material it was found that he marked several areas of the references during his review. When it was again brought to his attention that this was NOT ALLOWED he became belligerent, grabbed his items out of the hand of the test proctor, and stormed out of the building. All of this is recorded with both Audio and Video recordings.
If Mr. chooses to apologize to the proctor, and abide by the written notices he will be allowed to take the test again. But until those things occur our written procedures are that no retesting will be allowed.
At no time did anyone laugh at him or his explanation that he has a reading/learning disability as this would not be tolerated in the business. I am a disabled person myself (having broken my back in 1989) and suffer from physical limitations that have to be accommodated from time to time.
I will be more than happy to discuss this situation with Mr. but I also will fully support my staff member who was treated very poorly by Mr.. Additionally I will act in accordance with the written and verbal procedures given to Mr. prior to and after his test administrations. And please keep in mind that the video and audio recording can and have been been accessed to reply in addition to the incident report sent to the sponsoring county based upon the actions of Mr..
If you have further questions please feel free to contact me directly by return email or via telephone at our toll free number (800)997-2129.
