In response to the false claims by [redacted] representing Fun Cars of Fresno Calif. Most of the claims are false andunfounded.First off [redacted] was representing that he was purchasing the set for RESALE for a customer not his personnelvehicle. (see attached invoice NO TAX applied)Next [redacted] called about...
what he wanted and (just like he states) informed him they weren't ready "In Stock" forpick up and he would have to call ahead to make sure we had the set ready for him. [redacted] did send a Credit Card via textto my employee to use when his driver gets here. Mr [redacted]s driver showed unannounced for the pickup with no callahead. We got the product together, we then proceeded to try to use his credit card and it was DECLINED II We had hisdriver call [redacted] to get a credit card that would work- this is where all the wait time came from. During this time theDriver stated to us this is a NORMAL occurrence for him to have to sit and wait for [redacted] to complete the informationwith his pickups. False claims about Comp Cut-[redacted] never called ahead for the Comp Cut to be ready- Nor did wecharge for the Comp Cut tires. He was billed EXACTLY what a dealer for resale would pay. (see attached invoice- nocomp cut charge- handed to his driver unmounted). [redacted] received EXACTLY what he was billed for- His statement ofthe product causing issues with his car is false, the NON Comp cut tires are less aggressive than the Comp Cut tires. Anybelt issues would be because of Driver Error and improper use of the vehicle. Next per his statement of $120 cost ea.[redacted] is not using the FACTORY Polaris belt for his car. The Polaris belts cost the Polaris dealer from the factory $158and retail for $200. For backup I personally test with and work with Polaris in testing on belt issues. "0" belt issues withthe exact same sand setup if driven property.Next order [redacted] placed with me personally 1 week later saying he needed another setup mounted and shippedout. Not 1 comment at this time to an overchar,e on order picked up by his driver. We put the order together andshipped out, only difference in the cost to this order is the shipping charges.( Invoice has tracking numbers for UPSattached along with credit card receipt ) Informed [redacted] to ship back the product that was delivered and signed forUNUSED and we can credit him for the product. We have NOT received any product back.[redacted] is trying to mislead this whole situation, [redacted] and Fun Cars received a set of tires from us 4 years agothat was shipped to him in good faith, he received them , had a signature of receipt by one of his employees and thenrefused to pay for them in this same manner. This is a pattern with [redacted]. When the first order was ready to be giving tohis driver, I personally over the phone told [redacted] he needed to pay for the set of tires he owes us for before he can pickup. Difference in the $2432 charged and the Invoice $2060 is the balance of old Invoice. Have asked [redacted] for copies ofcharges he claims that were incorrect, he went directly into threats of Lawsuit.Next I spent some time looking into [redacted]' resale permit that he submitted to us and signed he was in theaftermarket offroad parts industry. No such permit valid for Fun Cars of Fresno. So [redacted] is fraudulently using his resalenumber for unrelated product for his personnel use. We should be requesting an additional $536 per order placedtotaling $1072 from [redacted] since these (as stated) are orders for personnel use.We have multiple employees, [redacted], [redacted] and [redacted] who were all involved in this matter and all remember howthis whole matter played out. First [redacted] called me threatening lawsuit then threatening to bash us if I didn't give himmoney. This is called Extortion- and [redacted] and the Revdex.com should Cease and Disist all unfounded claims made by [redacted] against Fullerton Sand Sports. Review: I Drove to Fullerton's store and explained to [redacted] the owner that I wanted a set of wheels and tires for my personal RZR 1000. He told me you would hook me up and that you didn't have the right ones in stock.
On Dec 23rd of 2014 I have a text sent to his employee authorizing one set of wheels (4) and one set of paddles (4). I sent him my credit card number via text.
On that same date, my driver sat there for 3 hours waiting on you to prepare tires. He left with the only set of wheels and tires we bought from them.
The wheels and tires were not buffed as he stated they would be, they were not comp cut as he stated they would be and they were not assembled as he stated they would be. So basically I did not receive what I paid for.
As I was leaving on vacation, I had no choice but to run them. The extra weight and extra paddles caused my RZR to break 3 belts at 120 a pop.
The tire he is known for making is a lighter and less aggressive tire specially cut for the RZR's
I did not receive what I paid for.
After that date there were no phone calls to His store or to any employee of your store as he stated in his first response. He stated that I called and ordered a second set. Not true. This is evident as we have our phone bills
On Dec 30th, his company fraudulently charged 2143.62 on my Visa again and sent the exact same set of wheels. He knows I only bought one set for my personal RZR.
Sandy became aware of multiple large charges on my Visa and brought it to my attention last week.
I sent him an email and he stated that I had called and ordered a second set. This is not true. He also stated that because we signed for them when they arrived here, that constitutes a sale. Also not true. We accept multiple packages daily into our receiving dept.Desired Settlement: That he refund my Visa the $160.00 he quoted me for the less expensive tires plus whatever I have to spend to get my tires comp cut and buffed so they will work on my RZR as that is what he promised me.
A full refund for the second set of identically wheels and tires that I never ordered. He claims my buddy wanted a set but he only wanted a price. This was way before any transaction actually took place and asking for a price does not constitute a sale.
I clearly text his employee authorization for one set of wheels for my RZR.
Fullerton Sand Sports is extremely unorganized and simply made a shipping error. There website does not say no returns nor does there invoice and they in fact do accept returns. Although this is clearly a accidental shipment the fact that they refuse to take their product that we never ordered back makes it a fraudulent charge on my card.
I would also like to challenge that they have the "Worlds largest selection In Stock Tire collection" This is untrue
